1. Consideration of adoption of modification to Attachment E of the State Water Resources Control Board Water Quality Order No. 2004-0009-DWQ, Statewide General National Pollutant Discharge Elimination System Permit for the Discharger of Aquatic Pesticides for Aquatic Weed Control in Waters of the United States, General Permit No. CAG990005 (Written comments must be received no later than 5 p.m. on May 23, 2005).

In the matter of the petitions of Trout Unlimited, Department of Fish and Game, and United States Fish and Wildlife Service (Failure to Adopt NPDES Permit for use of Rotenone in Silver King Creek) California Regional Water Quality Control Board, Lahontan Region. SWRCB Files A-1669, 1669(a). (The Board will consider, at a Board meeting, whether to adopt the proposed order affirming the decision of the Regional Board not to adopt the NPDES permit.)

LITIGATION (This is authorized under Government Code section 11126(e)(1).)
The Board will meet in closed session to discuss pending litigation regarding Yuba County Water Agency v. State Water Resources Control Board, Respondent and Defendant; Browns Valley Irrigation District et al., Real Parties in Interest. (Yuba County Superior Court YCSCCVPT 03-0000589 and Consolidated Cases recently transferred to San Joaquin County Superior Court.)

 

The Board encourages submittal of written comments. Unless otherwise specified, written comments must be submitted by 5:00 p.m., May 24, 2005 and will not be accepted after that time. Time limitations on presentations may be imposed.
