Administrative Civil Liability - Adelanto Public Utility Authority
On April 4, 2008, the Water Board's Assistant Executive Officer issued Administrative Civil Liability Complaint No. R6V-2008-0012 recommending a $15,000 assessment of civil liability to the Adelanto Public Utility Authority. The Complaint alleges that this party violated the Water Board’s Cease and Desist Order (CDO) No. R6V-2007-0024 by submitting the first CDO-required quarterly status report 23 days late.
On May 9, 2008, the Water Board's Prosecution Team agreed to settle the Complaint for $6,500, and received a signed Waiver of Hearing Form from the Adelanto Public Utility Authority. These actions constitute a proposed settlement of the Complaint.
The Water Board has initiated a 30-day public comment period for the proposed settlement and the associated proposed Administrative Civil Liability (ACL) Order. Written comments on the proposed settlement and proposed ACL Order will be accepted through September 5, 2008. The Water Board is now scheduled to consider the proposed settlement and ACL Order at its November 12-13 Board meeting in Barstow.
