  • Administrative Civil Liability - Adelanto Public Utility Authority

    On April 4, 2008, the Water Board issued Administrative Civil Liability Complaint No. R6V-2008-0012 recommending a $15,000 assessment of civil liability to the Adelanto Public Utility Authority. The Complaint alleges that this party violated the Water Board’s Cease and Desist Order (CDO) No. R6V-2007-0024 by submitting the first CDO-required quarterly status report 23 days late. If the party does not waive its right to a public hearing, the Complaint will be considered by the Water Board at a public hearing currently scheduled for its June 11-12, 2008 meeting in Victorville.   • Administrative Civil Liability Complaint Issued to Everd A. McCain, B. J. Deis, and McCain and Associates for Violations of the Clean Water Act, California Water Code, and Waste Discharge Prohibitions Specified by the Water Quality Control Plan for the Lahontan Region, Skeet Dam and Buzz Dam, Belfast Ranch, Lassen County
    On November 16, 2007, the Regional Board issued Administrative Civil Liability Complaint No. R6T-2007-0007 recommending a $100,000 assessment of civil liability to Everd A. McCain, B.J. Deis, and McCain and Associates.

    The Water Board held a hearing on the matter on March 13th in Truckee and continued the hearing to a later meeting to allow the parties an opportunity to try to reach a structured settlement that would include stabilization of the dam sites and a penalty of some cash value.
