Mandatory Minimum Penalty (MMP) for Sierra Boat Company

Overview

On August 26, 2016, the Lahontan Regional Water Quality Control Board's (Water Board) Assistant Executive Officer issued the Sierra Boat Company (SBC) a Notice of Violation and Expedited Payment Settlement Offer (Settlement Offer). The Notice of Violation alleged that SBC had violated effluent limitations specified by Water Board Order No. R6T-2011-0024, NPDES Permit No. CAG616003 (permit). The permit was adopted by the Water Board on April 13, 2011, and establishes waste discharge requirements for the discharge of waste from the SBC Marina to Lake Tahoe in Placer County.

On October 13, 2016, Water Board staff met the discharger at the facility to review the information provided regarding the sampling location for the samples which resulted in the effluent limit violations of the subject MMP. The Discharger provided sufficient information to demonstrate that the sample location and sampling technique likely resulted in non-representative results for the storm water discharge. ON November 21, 2016 the alleged violations were dismissed.
