Agenda

Submittal of Written Material for Panel Consideration

The parties to these items must submit any written comments, a list of witnesses, and any exhibits to the Executive Officer not later than May 13, 2002. Failure to comply with these requirements is grounds for the Panel to refuse to admit the proposed written comment or exhibit into evidence. (California Code of Regulations, title 23, section 648.4)

If materials are not submitted in a timely manner, the Hearing Panel may refuse to admit written testimony into evidence unless the proponent can demonstrate why he or she was unable to submit the material on time or that compliance with the deadline would otherwise create a hardship. If any other party demonstrates prejudice resulting from admission of written comments or exhibits not timely submitted, the Hearing Panel may refuse to admit it.

The Hearing Panel is authorized to enter into closed session to deliberate on the evidence received in each of these matters. (Government Code section 11126(c)(3))

If you are reading a statement at the hearing, please provide the Executive Assistant with a copy at the Hearing.

The Hearing Panel will endeavor to consider all matters listed on this agenda. However, time may not allow the Panel to hear all matters listed. Matters not heard at this hearing may be carried over to the next Panel Hearing or to a future Regional Board meeting. Parties will be notified in writing of the rescheduling of their item. Please contact the Regional Board staff to find out about rescheduled items.

The Panel will recess for a 15-minute break at approximately 10:45 a.m. and recess for lunch at approximately 12:00 p.m. The hearing will reconvene at approximately 1:15 p.m.

  1. Consideration of Complaint No. R4-2002-0009-R to assess Mandatory Minimum Penalties in the amount of $36,000 pursuant to Water Code sections 13385(h) & (i) against RMR Properties for violation of its Waste Discharge Requirements.
    (After a hearing to receive evidence and testimony concerning the Complaint, the Panel will make findings of fact, conclusions of law and a proposed decision and order for presentation to the Board when the Board considers whether to affirm, modify, or rescind the Complaint in the amount of $36,000.)

Consideration of Complaint No. R4-2002-0018 to assess Administrative Civil Liability in the amount of $6,980 against Alpine Paper Recycling for violation of California Water Code section 13399.30 for failing to file an appropriate Notice of Intent to obtain coverage under General Permit No. CAS00001 or a Notice of Non-applicability that specifies the basis for not needing to obtain coverage under General Permit No. CAS00001.

Pursuant to Water Code section 13320, any aggrieved person may file a petition to seek review by the State Water Resources Control Board (SWRCB) of any action taken by the Regional Board.
