Timber Waiver and General Waste Discharge Requirements Guidance

On May 8, 2014, the California Regional Water Quality Control Board, North Coast Region adopted a revised Waiver 'ORDER NO. R1-2014-0011', Categorical Waiver of Waste Discharge Requirements For Discharges Related to Timber Harvesting Activities On Non-Federal Lands in the North Coast Region. This Waiver can provide coverage for several categories of timber harvesting projects, including THPs, Modified THPs (MTHPs), Emergencies, Exemptions, and timber harvest projects that the Regional Water Board Executive Officer has determined are in compliance with an approved sediment TMDL Action Plan. Order No. 2014-0011 renews the 2009 Categorical Waiver and includes revised findings, minor reorganization, revisions to general conditions (Section I) and the specific conditions of Categorical Waivers C and F (Section II), and revised application procedures (Section III). Landowners and other interested parties are encouraged to read the new Order. Regional Board staff are available to answer questions regarding the Categorical Waiver and are more than happy to conduct site visits to help landowners and foresters understand the conditions of the Waiver and what is necessary to satisfy those conditions.

General Waste Discharge Requirements for Discharges Related to Timber Activities on Non-Federal Lands in the North Coast Region

Introduction

On June 23, 2004, the North Coast Regional Water Quality Control Board adopted Order No. R1-2004-0030, General Waste Discharge Requirements for Discharges Related to Timber Activities on Non-Federal Lands in the North Coast Region. These General Waste Discharge Requirements (General WDRs) contain discharge prohibitions, receiving water limitations, a requirement for the submittal of some technical reports, an inspection schedule, and a filing/annual fee. This Order rescinds Order No. R1-2003-0116, except for application to Projects that were accepted for filing by the California Department of Forestry and Fire Protection prior to June 23, 2004 and obtain coverage under R1-2004-0116 by October 15, 2004.

Waiver of Waste Discharge Requirements for Nonpoint Source Discharges Related to Certain Federal Land Management Activities on National Forest System Lands

INTRODUCTION

The North Coast Regional Water Quality Control Board adopted Order No. R1-2015-0021, Waiver of Waste Discharge Requirements for Nonpoint Source Discharges Related to Certain Federal Land Management Activities on National Forest System Lands in the North Coast Region on October 8, 2015. This order waives certain activities conducted on National Forest System Lands from the waste discharge requirements of Article 4 (commencing with Section 13260) of Chapter 4, Division 7 of the California Water Code, except as provided within the waiver. This Order rescinds and replaces portions of Order No. R1-2010-0029. Order No. R1-2015-0021 expires on October 8, 2020.

Waiver of Waste Discharge Requirements for Nonpoint Source Discharges Related to Certain Federal Land Management Activities on National Forest System Lands

INTRODUCTION

The North Coast Regional Water Quality Control Board adopted Order No. R1-2010-0029, Waiver of Waste Discharge Requirements for Nonpoint Source Discharges Related to Certain Federal Land Management Activities on National Forest System Lands in the North Coast Region on June 10, 2010. This order waives certain activities conducted on National Forest System Lands from the waste discharge requirements of Article 4 (commencing with Section 13260) of Chapter 4, Division 7 of the California Water Code, except as provided within the waiver. This Order rescinds and replaces portions of Order No. R1-2004-0015 that covered timber harvesting and related activities on Federal lands. Order No. R1-2010-0029 expires on June 10, 2015.

The North Coast Regional Water Quality Control Board, U.S. Forest Service Liaison Team traveled to Yreka, Eureka, Redding, and Willows during the fall 2010 through early spring 2011 to meet with representatives of the Klamath, Six River, Shasta-Trinity, Modoc, and Mendocino National Forests, to introduce and discuss the newly adopted USFS Waiver.  During these meetings, a list of questions regarding the USFS Waiver was generated and Regional Water Board staff responded to these questions.  A link to the USFS Waiver Questions and Answers is provided below.

INTRODUCTION

On March 24, 2004 the North Coast Regional Water Quality Control Board adopted Order No. R1-2004-0015, Categorical Waiver for Discharges Related to Timber Harvest Activities On Federal Lands Managed by the United States Department of Agriculture, Forest Service in the North Coast Region.  This order waived certain activities conducted on National Forest System Lands from the waste discharge requirements of Article 4 (commencing with Section 13260) of Chapter 4, Division 7 of the California Water Code, except as provided within the waiver.  Order No. R1-2004-0015 was rescinded upon adoption of Order No. R1-2010-0029 on June 10, 2010.
