- ACL Complaint No. R9-2005-0265 for Mandatory Minimum Penalties and Administrative Civil Liability against the City of Escondido, Hale Avenue Resource Recovery Facility
On December 30, 2005, the Assistant Executive Officer issued Administrative Civil Liability Complaint No. R9-2005-0265 against the City of Escondido for numerous violations resulting from the treatment, transport, and disposal of sewage from the Hale Avenue Resource Recovery Facility (HARRF). The Complaint includes both mandatory minimum penalties and discretionary liability as authorized by the California Water Code. A settlement adopted by the Regional Board in October 2006 was negated and remanded back to the Regional Board by the State Water Resources Control Board in October 2007. The Regional Board has scheduled a public hearing on the violations alleged in the Complaint on August 13, 2008. Written comments regarding the allegations alleged in the Complaint will be accepted until 5:00 p.m., Monday July 14, 2008.

Complaint No. R9-2008-0019 for Mandatory Minimum
Penalty against Bill and Heidi Dickerson, and Perry & Papenhausen Construction
On March 14, 2008, the Regional Board issued Complaint
No. R9 2008-0019 against Bill & Heidi Dickerson,
and Perry & Papenhausen Construction, Inc. in
the amount of $45,000 for copper effluent violations
of their construction dewatering discharge permit
to San Diego Bay, R9-2000-0090.
A public hearing is scheduled for the August 15, 2008,
Regional Board meeting. Written comments regarding
the allegations contained in Complaint No. R9 2008-0009,
will be accepted through Friday, July 11, 2008. The
Regional Board's August 13, 2008, meeting will be

- ACL Complaint No. R9-2008-0021 Against North
County Transit District (NCTD), Sprinter Rail Project
On March 4, 2008, the California Regional Water
Quality Control Board, San Diego Region (Regional
Board) issued Complaint No. R9 2008-0021 to the
North County Transit District (NCTD) in the amount
of $685,000 for: 1) failure to implement adequate
Best Management Practices and 2) unregulated discharges
of sediment to a Municipal Separate Storm Water
System (MS4) and Waters of the United States.
A
public hearing is scheduled for the June 11, 2008,
Regional Board meeting. Written comments regarding
the allegations contained in Complaint No. R9 2008-0021,
and/or acceptance of the waiver will be accepted
through Wednesday May 21, 2008. The Regional Board's
June 1, 2008, meeting will be at the Regional Board
office located at 9174 Sky Park Court, San Diego,

On September 28, 2007, the Regional
Board issued Administrative Civil Liability Complaint
No. R9-2007-0099, recommending a $1,095,000 assessment
of civil liability against the City of Vista and
the City of Carlsbad. The complaint alleges that
the City of Vista and City of Carlsbad discharged
7.3 million gallons of raw sewage into Buena Vista
Lagoon, a water of the United States, from a force
sewer main during March/April 2007. The public
hearing is scheduled for the March 12, 2008 meeting
of the Regional Board. A copy of the tentative
Order that would implement the terms of the settlement
is available below.
- San
Diego County Water Authority, San Vicente Pipeline
Dewatering Project: On January 22, 2007, the Regional
Board Executive Officer issued Administrative Civil
Liability Compliant No. R9-2007-0014 recommending
a $120,000 assessment of civil liability against
San Diego County Water Authority for violations
of effluent limitations contained in Order No. 2001-96,
NPDES No. CAG919002, General Waste Discharge Requirements
and Similar Waste Discharges from Construction,
Remediation, and Permanent Groundwater Extraction
Projects to Surface Waters Within the San Diego
Region Except San Diego Bay.
The Complaint alleges
that San Diego County Water Authority exceeded the
instantaneous maximum and average monthly effluent
limitations for total nitrogen on 43 occasions between
December 2005 and November 2006. A public hearing
is scheduled for April 11, 2006.
