Weight of Evidence: A TMDL has been developed and approved by USEPA (2/29/2008) and an approved implementation plan is expected to result in attainment of the standard. This provides a sufficient justification in favor of placing this water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list.


This pollutant is being considered for for listing under section 2.2 of the Listing Policy. Under this section of the Policy, a minimum of one line of evidence is needed to assess listing status.

The Basin Plan amendment incorporating a TMDL and water quality attainment strategy for Diazinon and pesticide-related toxicity in the Bay Area's urban creeks has been incorporated into the Water Quality Control Plan for the San Francisco Bay Basin (Basin Plan). The amendment was adopted by the Regional Water Board on November 16, 2005, and approved by the State Water Resources Control Board on November 15, 2006. It has been approved by the State Water Board, the Office of Administrative Law, and the federal Environmental Protection Agency.

Based on the readily available information, the weight of evidence indicates that there is sufficient justification in favor of placing this Water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list.
