Water Body Type: Coastal & Bay Shoreline

DECISION ID
6276
Region 3
Pacific Ocean at Stillwater Cove Beach

Pollutant: Indicator Bacteria
Final Listing Decision: Delist from 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: List on 303(d) list (TMDL required list)(2006)
Revision Status Revised
Reason for Delisting: Change from general pollutant to specific pollutant listing (e.g. metals to copper)
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for removal from the section 303(d) list under section 4.1 of the Listing Policy. Under section 4.1 a single line of evidence is necessary to assess listing status.

As of 2006, Pacific Ocean at Stillwater Cove Beach, is listed for Indicator Bacteria. It is not possible, in a general listing, to determine which specific pollutant is causing or contributing to a water quality impacts.

There is sufficient justification for removing the general listings for Indicator Bacteria from the 303(d) list and replace this general listings with decisions for each of the specific pollutants that apply. See decisions for Enterococcus, E. coli, Fecal Coliform and Total Coliform.

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the section 303(d) list because It is not possible, in a general listing, to determine which specific pollutant is causing or contributing to a water quality impacts. This general listings will be replaced with decisions for each of the specific pollutants that apply

State Board Review of Regional Board Conclusion and Recommendation:

State Board Decision Recommendation: After review of this Regional Board decision, SWRCB staff recommend the decision be approved by the State Board.

Water Quality Objective/Criterion: Assembly Bill 411:
Weekly monitoring is required from April to October at all beaches with more than 50,000 annual visitors or at beaches located in areas adjacent to storm drains that flow during the summer. Some counties continue testing year round. Weekly samples must be tested for three indicator organisms: total coliform, fecal coliform, and enterococcus. Beaches that fail to meet the state's criteria for any one of the three indicators are to be posted with conspicuous warning signs to notify the public of health risks associated with swimming in these areas. Closings and advisories are issued on a discretionary basis. AB 411 requires the State Water Resources Control Board (SWRCB) to post monthly beach data from coastal counties throughout the state. The surveys list beach warnings, beach closures, and rain advisories resulting from bacterial contamination.

Region 3
Pacific Ocean at Stillwater Cove Beach

Pollutant: Escherichia coli (E. coli)
Final Listing Decision: Do Not List on 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: New Decision
Revision Status Revised
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.3 of the Listing Policy. Under section 3.3 a single line of evidence is necessary to assess listing status.

Two lines of evidence are available in the administrative record to assess this pollutant. When compared to the Ocean Plan Objectives for Water Contact Recreation, none of 4 samples exceeded the single sample maximum Objective. No geomean assessments were made because no two samples were collected with a given 30-day period.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. none of 4 samples exceeded the single sample maximum Objective and this does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy. In addition, the sample size is insufficient to determine if the beneficial use is impaired.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because it cannot be determined if applicable water quality standards are not being exceeded.

State Board Review of Regional Board Conclusion and Recommendation:

Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.3 of the Listing Policy. Under section 3.3 a single line of evidence is necessary to assess listing status.

Two lines of evidence are available in the administrative record to assess this pollutant. When compared to the Ocean Plan Objectives for Water Contact Recreation, 8 of 59 samples exceeded the single sample maximum Objective, 2 of 15 geomean assessments exceeded the geomean Objective.

3. Eight of 59 samples exceeded the single sample maximum Objective, 2 of 15 geomean assessments exceeded the geomean Objective. Neither of these exceeds the allowable frequency listed in Table 3.2 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because applicable water quality standards are not being exceeded.

Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.3 of the Listing Policy. Under section 3.3 a single line of evidence is necessary to assess listing status.

Eight lines of evidence are available in the administrative record to assess this pollutant. Five of the LOE summarize the data and information used in the 2006 assessment. The following is a summary of that information. None of 79 means were in exceedance of the criteria, 0 of 122 and 3 of 122 samples were in exceedance of the single sample criterion for Enterococcus, and these do not exceed the allowable frequency listed in Table 3.1 of the Listing Policy. Twenty one advisories/warnings were posted from 1999 to 2003. Rain Advisories for all beaches in the county were posted on 15 occasions from 2000 to 2004.

Three additional LOE summarize data collected weekly between February 2005 and October 2006. When compared to the Ocean Plan Objectives for Water Contact Recreation, none of 60 samples exceeded the single sample maximum Objective, none of 15 geomean assessments exceeded the geomean Objective and 2 of 59 exceeded the total to fecal coliform ratio Objective.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The Assembly Bill 411criteria used complies with the requirements of section 6.1.3 of the Policy.
2. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
3. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
4. Based on section 3.3 the site does not have significant bacterial toxicity and the pollutant is not likely to cause or contribute to the toxic effect.

Regional Board Conclusion: Regional Board Conclusion:
This pollutant is being considered for placement on the section 303(d) list under section 3.3 of the Listing Policy. Under section 3.3 a single line of evidence is necessary to assess listing status.

Six lines of evidence are available in the administrative record to assess this pollutant. Four of the LOEs describe data prior to 2005 and are summarized here. None of 76 means were in exceedance of the criteria, 8 of 81 samples were in exceedance of the single sample criterion for Enterococcus, and these do not exceed the allowable frequency listed in Table 3.1 of the Listing Policy. Twenty one advisories/warnings were posted from 1999 to 2003. Rain Advisories for all beaches in the county were posted on 15 occasions from 2000 to 2004.

Two additional LOE summarize weekly data collected between February 2005 and October 2006. Six of 60 samples were in exceedance of the single sample criterion for Enterococcus and 2 of 15 samples were in exceedance of the geomean criterion for Enterococcus. Based on section 3.3 the site does not have significant bacterial toxicity and the pollutant is not likely to cause or contribute to the toxic effect.

5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

State Board Review and Conclusi n:

Based on comments received from U.S. EPA (comment letter # 60), on the April 19, 2010 State Water Board staff report for the 2010 Integrated Report, State Water Board staff recommended to place this water body on the 303(d) list for enterococcus based on the addition of 2 LOEs (31434 and 31435) assessing the AB411 (dry weather) data for this water body. Staff reviewed the bacteria data for this water body in the Central Coast Region described in the comment letter. Staff recommendation has changed for this water body - pollutant combination based on evaluation of the dry weather data that was not included in the original Central Coast Region assessment.

On August 4, 2010 the State Water Board approved the staff listing recommendation to place this water body on the 303(d) list for enterococcus.

The final language for the recommendation is:

This pollutant is being considered for placement on the section 303(d) list under section 3.3 of the Listing Policy. Under section 3.3 a single line of evidence is necessary to assess listing status. Eight lines of evidence are available in the administrative record to assess this pollutant.

Based on section 3.3 the site does not have significant bacterial toxicity and the pollutant is not likely to cause or contribute to the toxic effect.

This water body segment is identified as an AB411 beach and data collected during the time frame of April 1st to October 31st (dry weather) is assessed using a four percent exceedance percentage (section 3.3 of Listing Policy).

There are two additional lines of evidence for dry weather single sample and geometric mean calculations. Six of 58 samples exceeded the recreational use single sample criteria and 2 of 13 geometric mean calculations exceeded the geometric mean criteria.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for placing this water segment-pollutant combination on the section 303(d) list.

4. Six of 60 samples were in exceedance of the single sample criterion for Enterococcus and 2 of 15 samples were in exceedance of the geomean criterion for Enterococcus. Neither of these exceed the allowable frequency listed in Table 3.2 of the Listing Policy.
5. Six of 58 dry weather samples exceeded the recreational use water quality objective and this exceeds the allowable frequency listed in Table 3.2 (at a four percent exceedance percentage-AB411) of the Listing Policy.
6. Two of 13 dry weather geo-metric mean calculations exceeded the recreational use geo-metric mean criteria. This exceeds the allowable frequency listed in Table 3.2 (at a four percent exceedance percentage-AB411) of the Listing Policy

Data Used to Assess Water Quality: Monterey County posted 21 warnings and advisories from 1999 through 2004 for high bacteria (fecal, and Enterococcus), log mean exceedances, and total/fecal bacteria ratio exceedances. Additionally, there was one closure due to a sewage spill in 2002. Each lasted for several days (CCRWQCB, 2004d).
