Regional Board Conclusion: 303(d) listing decisions made prior to 2006 were not held in an assessment database. The Regional Board will update this decision when new data and information become available and are assessed. Delisting cannot be justified at this time.

The original listing for "Priority Organics" was for violation of Office of Environmental Health Hazard Assessment (OEHHA) MTRL fish tissue criteria for PCBs and chlordane. The MTRLs were updated prior to the 2002 assessment cycle, and only the MTRL for PCBs was being violated at the time. For 2006, State Water Board staff prepared a line of evidence assessing the PCB data against OEHHA's Screening Value criterion. Two out of two samples violated that criterion.

Region 6 sponsored additional tissue sampling from Donner Lake, and the data from that study, along with the data used in the original listing, are now undergoing quality assurance/quality control checks. The final data from this study will be used in the next assessment cycle and may result in replacement of the "Priority Organics" listing with more specific listings for individual chemicals.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.
