Regional Board Conclusion: This pollutant is being considered for removal from the section 303(d) list under section 4.2 of the Listing Policy. Under section 4.2 a one line of evidence is necessary to assess delisting status.

Four lines of evidence are available in the administrative record to assess this pollutant. A sufficient number of samples exceed the water quality objective.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. 38 of 139 United Water Conservation District samples exceeded the TDS water quality objective and this exceeds the allowable frequency listed in Table 4.2 of the Listing Policy.
5. 13 of 51 County Sanitation District of Los Angeles County samples exceeded the TDS water quality objective and this exceeds the allowable frequency listed in Table 4.2 of the Listing Policy.
6. Two of 24 MS4 samples exceed the water quality objective from the Basin Plan for the Coastal Watersheds of Los Angeles and Ventura Counties and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy.
7. Zero of one SWAMP sample exceed the water quality objective from the Basin Plan for the Coastal Watersheds of Los Angeles and Ventura Counties and there are insufficient data to determine whether this exceeds the allowable frequency listed in Table 4.2 of the Listing Policy.
8. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Spatial Representation: The County Sanitation District of Los Angeles County conducted sampling at Santa Clara Reach 5 at the following monitoring stations : R1 located at Peck drain at Converse Road Bridge at the edge of the river bed about half a mile above the confluence with the low flow river stream; R2 located about 300 feet upstream from confluence with Peck drain; and R3 located approximately 300 feet downstream from the confluence with Peck Drain.

Evaluation Guideline: Toxicity was defined as a reduction of the NOEC below 100% and was considered significant if the effect on the sample exposure was greater than 25%. Chronic toxicity is further expressed as toxic units (TUc), where TUc = 100/NOEC.
The No Observable Effect Concentration (NOEC) is expressed as the maximum percent of receiving water that causes no observable effect on a test organism, as determined by the result of a critical life stage toxicity test. The NOEC is defined, in USEPA, 2002 as the the lowest concentration of toxicant to which organisms are exposed in a life-cycle or partial life-cycle (short-term) test, which causes adverse effects on the test organisms (i.e., where the values for the observed responses are statistically significantly different from the controls).

One line of evidence is available in the administrative record to assess this pollutant. Based on the applicable factor, a TMDL has been developed and approved by USEPA and an approved implementation plan is expected to result in attainment of the standard. The Santa Clara River Nitrogen TMDL was approved by RWQCB on August 7, 2003 and subsequently approved by USEPA on March 18, 2004.

This water segment-pollutant combination was moved off the section 303(d) list during the 2002 listing cycle.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list.
