Regional Board Conclusion:	Regional Water Board Conclusion: Regional Water Board decision recommendation was as a placeholder for the listing because the listing was made prior to 2006 and detailed information was not held in an assessment database. No new data were assessed for 2008. State Water Board Conclusion: State Water Board Resolution No 2010-0040 approved the State's Proposed 2010 Integrated Report (including decision fact sheets and associated lines of evidence) which identified this water body as impaired for Electrical Conductivity. The transmittal letter of the 2010 Integrated Report for the 303(d) list (from Thomas Howard, SWRCB, to Alexis Strauss, USEPA Region 9, dated October 11, 2010), noted to USEPA that the State Water Board's recommendation to retain on the list this water body pollutant combination, was being held in abeyance due to existing litigation. With that recommendation, the State Water Board did not delist that water body pollutant combination, but instead withheld its recommendation pending a decision by USEPA regarding that water body. USEPA Final Conclusion According to the November 12, 2010 USEPA partial approval, partial disapproval letter and enclosure for California's 2008-2010 list (from Alexis Strauss, USEPA Region 9, to Tom Howard, SWRCB), USEPA stated that it understood the State Water Board's October 11, 2010 transmittal letter, which held several of its listing recommendations in abeyance, as "the State is not listing" those water body-pollutant combinations (enclosure, at pages 6-7). That November 12, 2010 USEPA letter (cover letter, page 1) stated: "[W]e conclude that several of the listings which the State determined to hold in abeyance meet federal listing requirements. The water bodies and associated pollutants that we are adding to the State's 2008-2010 list of water quality limited segments are identified in Table 3 in the enclosure. The statutory and regulatory requirements, a summary of our review of California's compliance with applicable requirements and our rational for adding the water bodies and pollutants is described in the enclosure." However, the October 11, 2011 USEPA final decision letter with enclosures and responsive summary for California's 2008-2010 list (from Alexis Strauss, USEPA Region 9, to Tom Howard) addressed the electrical conductivity listing for San Joaquin River (Mendota Pool to Bear Creek) with the following statements (cover letter, page 1): "With respect to electrical conductivity, EPA concludes that data show impairment for electrical conductivity in four segments of the San Joaquin River: San Joaquin River: - San Joaquin River (Bear Creek to Mud Slough) - San Joaquin River (Mud Slough to Merced River) - San Joaquin River (Merced River to Tuolumne River) - San Joaquin River (Tuolumne River to Stanislaus River) "However, further data review of San Joaquin River (Mendota Pool to Bear Creek) did not confirm clear impairment of the applicable water quality standards, so this water body segment is not included on the 303(d) list for electrical conductivity." Pursuant to the aforementioned review and conclusion by USEPA, summarized in the October 11, 2011 USEPA final decision letter for California's 2008-2010 list (from Alexis Strauss, USEPA Region 9, to Tom Howard), the San Joaquin River (Mendota Pool to Bear Creek) shall not be included on the 2010 303(d) list

Regional Board Conclusion:	This pollutant is being considered for removal on the section 303(d) list under sections 2.2 and 4.1 of the Listing Policy. Under 4.1 of the Policy, a minimum of one line of evidence is needed to assess listing status. One lines of evidence are available in the administrative record to assess this pollutant. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. There is sufficient justification to place it in the Being Addressed portion of the 303(d) list because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 4.1 of the Policy. 2. The data used satisfies the data quantity requirements of section 4.1 of the Policy. 3. None of 4 of 4 available 4-day average concentrations exceeded the 4-day average maximum concentration criterion and this does not exceed the allowable frequency listed in Table 3.1 of the Listing Policy. The size of samples is not sufficient to be used for removal the pollutant from the list because at least 28 samples are needed before a pollutant can be considered for removal from the list using the frequencies presented in Table 4.1 of the listing policy. 4. The San Joaquin River Organophosphorous Pesticide TMDL has been approved by the Central Valley Water Board in 2005 and approved by USEPA on 12/20/2006. 5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Conclusion:	This pollutant is being considered for placement on the section 303(d) list under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. One lines of evidence are available in the administrative record to assess this pollutant. Five of the samples exceed the water quality objective. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Five of 95 samples exceeded the pH objective and this does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
