Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list.

2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Eleven of 38 samples exceeded the water quality objective and this exceeds the allowable frequency listed in Table 4.2 of the Listing Policy.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Data Used to Assess Water Quality: 19 samples were collected between August 2004 and October 2006. Three samples were collected in August 2004. Samples were collected at a monthly frequency between January 2005 and October 2006.
Samples were collected from the Lower Kings River at Jackson Avenue and James Bypass Weir
No toxaphene was detected in any of the samples. The reporting limits, ranged from 2.2 ug/L to 0.36 ug/L. Since none of the reporting limits were below the California Toxics Rule criteria concentration of 0.0002 ug/L, these samples could not be used to determine compliance with water quality standards, according to section 6.1.5.5 of the Listing Policy.
