This pollutant is being considered for removal from the section 303(d) list under section 4.3 (Bacteria) of the Listing Policy. Under section 4.3 a single line of evidence is adequate to assess listing status.

The 2008 Line of Evidence (LOE # 10843) is identical to and replaces the 2006 LOE (LOE# 1887).Therefore, two lines of evidence are available in the administrative record to assess this pollutant.

Based on the readily available data and information, the weight of evidence indicates that there is insufficient justification in favor of removing this water segment-pollutant combination from the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Less than 26 samples were available for analysis. More samples are needed in order to reliably determine if a water quality objective is exceeded. Five of six samples exceeded the water contact recreation objective.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

The pollutant name for this decision has been changed from "Nitrate as NO3" to "Nitrate". The decision has not changed.

This pollutant is being considered for removal from the section 303(d) list under section 4.1 of the Listing Policy. Under section 4.1 a single line of evidence is adequate to assess listing status. Using the binomial distribution, waters shall be placed on the section 303(d) list if the number of measured exceedances supports rejection of the null hypothesis as presented in Table 3.1.

Four lines of evidence are available in the administrative record to assess this pollutant. Five of 6 samples exceeded the Municipal and Domestic Supply water quality objective for Nitrate and 1 of 6 samples exceeded the Agricultural Supply water quality objective for Nitrate. In addition, all 6 samples exceeded the Evaluation Guideline for Nitrate established for aquatic life beneficial uses using the Numeric Nutrient Endpoint tool.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list.

This conclusion is based on the staff findings that:
