ITEM 7: PROPOSED AUTHORIZATION TO NEGOTIATE AND EXECUTE A LABORATORY SERVICES CONTRACT FOR FISCAL YEARS (FY) 1998-1999, 1999-2000, AND 2000-2001 ON BEHALF OF THE CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD, SAN FRANCISCO BAY REGION (SAN FRANCISCO BAY REGIONAL BOARD)

DISCUSSION: The San Francisco Bay Regional Board uses the services of outside laboratories to provide analyses of water and soil samples. Samples are taken by the San Francisco Bay Regional Board for a variety of reasons, including compliance monitoring, enforcement actions, special water quality studies, and update of basin plans. The San Francisco Bay Regional Board had a three-year laboratory services contract for FYs 1995-96, 1996-97, and 1997-98. To reduce staff resource costs needed for the competitive bidding process and for the negotiation and execution of a contract on an annual basis, a three-year contract is proposed covering FYs 1998-1999, 1999-2000, and 2000-2001.

The San Francisco Bay Regional Board proposed baseline laboratory services budgets are $106,765, $106,765, and $106,765 for FYs 1998-1999, 1999-2000, and 2000-2001, respectively. In addition, the U. S. Department of Defense-Spills, Leaks, Investigations, and Complaints (DOD-SLIC) Program's budget is expected to include a laboratory services allocation of $10,000 per year in FYs 1998-1999, 1999-2000, and 2000-2001. The San Francisco Bay Regional Board is proposing to combine these funds in a three-year laboratory services contract in the aggregate amount of $350,295, subject to availability of funds, for FYs 1998-1999, 1999-2000, and 2000-2001. See Table 1 below. As the total contract amount exceeds $200,000, a special resolution from the State Resources Control Board (State Board) is required.

POLICY ISSUE: Should the State Board authorize the Executive Director or his designee to negotiate and execute a three-year laboratory services contract on behalf of the San Francisco Bay Regional Board for FYs 1998-1999, 1999-2000, and 2000-2001 in an amount not to exceed $350,295, subject to availability of funds?

FISCAL IMPACT: The projected FYs 1998-1999, 1999-2000, and 2000-2001 budgets for the San Francisco Bay Regional Board would include $106,765 annually (Task 122-91) and $10,000 annually (Task 169-06) for external laboratory services. The proposed three-year contract would encumber all of those funds.

STAFF RECOMMENDATION: That the State Board authorize the Executive Director or his designee to negotiate and execute a three-year laboratory services contract to support the water quality monitoring activities of the San Francisco Bay Regional Board in an amount not to exceed $320,295 in General Fund monies and $30,000 in DOD-SLIC monies for FYs 1998-1999, 1999-2000, and 2000-2001, subject to availability of funds.

RESOLUTION NO. 98-

AUTHORIZING NEGOTIATION AND EXECUTION OF A LABORATORY SERVICES CONTRACT FOR FISCAL YEARS (FY) 1998-1999, 1999-2000, AND 2000-2001 ON BEHALF OF THE CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD, SAN FRANCISCO BAY REGION (SAN FRANCISCO BAY REGIONAL BOARD).

WHEREAS:

1. The San Francisco Bay Regional Board has a continuing need for laboratory analyses of water quality samples taken as part of its regulatory programs.

2. The San Francisco Bay Regional Board's use of water quality sampling and analysis is an important part of the State Water Resources Control Board's regulatory program.

3. The San Francisco Bay Regional Board needs to solicit bids for water laboratory services in support of its regulatory program.

THEREFORE BE IT RESOLVED THAT:

The State Water Resources Control Board:

Authorizes the Executive Director or his designee to negotiate a three-year laboratory services contract to support the water quality monitoring activities of the San Francisco Bay Regional Board in the amount not to exceed $320,295 in General Fund monies and $30,000 in U. S. Department of Defense-Spills, Leaks, Investigations, and Complaints monies for FYs 1998-1999, 1999-2000, and 2000-2001, subject to availability of funds.
