CONSIDERATION OF A RESOLUTION TO APPOINT MEMBERS AND ALTERNATES TO THE ASSEMBLY BILL (AB) 982 PUBLIC ADVISORY GROUP (PAG)

 

DISCUSSION:

 

California Water Code Section 13191 (AB 982, Ducheny) requires the State Water Resources Control Board (SWRCB) to convene an advisory group or groups to assist in the evaluation of program structure and effectiveness as it relates to the implementation of the requirements of Section 303(d) of the Federal Clean Water Act (CWA), applicable federal regulations, and surface monitoring and assessment programs.  It further states that the advisory group(s) shall be comprised of persons concerned with the requirements of CWA Section 303(d).

 

Interested parties representing various organizations and the general public were invited to attend two organizational meetings to establish the advisory group.  Parties attending the meetings included:  municipal dischargers, storm water dischargers, industrial dischargers, irrigated agriculture representatives, forestry representatives, water purveyors, environmental groups, wildlife conservation groups, citizen monitoring groups, and public interest groups. 

Twenty four members (and their alternates) were nominated for the PAG, including 12 members from the environmental community and 12 members from the regulated community (Attachment).  Future meetings will focus on critical issues pertaining to surface water quality monitoring programs and CWA Section 303(d) including issues related to Total Maximum Daily Loads (TMDLs).

 

POLICY ISSUE:

 

Should the SWRCB:

 

1.  Appoint the recommended individuals to form the PAG to advise the SWRCB with respect to the implementation of AB 982? 

 

2.  Delegate to the Executive Director authority for future membership and operating procedures for the PAG?

 

3.  Delegate to the Executive Director the authority to fill vacancies and replace PAG members for just cause?

 

FISCAL IMPACT:

 

Travel and per diem expenses at State rates are allowed for statutory required appointments.  Such expenses will be funded from existing budgetary authority for the PAG members that request travel funds for regularly scheduled PAG meetings.  Travel will be authorized for an alternate committee member if a committee member cannot attend a regularly scheduled meeting.  DWQ estimates travel costs will not exceed $20,000 per fiscal year and can be absorbed within the existing resources.  DWQ will work with the Budget Office to ensure adequate funding is available.  At present, the members of the AB 982 PAG are serving without compensation.

STAFF RECOMMENDATION:

 

That the SWRCB:

 

1.  Appoint the recommended individuals to form the PAG to advise the SWRCB with respect to the implementation of AB 982. 

 

2.  Delegate to the Executive Director authority for future membership and operating procedures for the PAG.

 

3.  Delegate to the Executive Director the authority to fill vacancies and replace PAG members for just cause.

APPOINTMENT OF MEMBERS AND ALTERNATES TO THE

ASSEMBLY BILL (AB) 982 PUBLIC ADVISORY GROUP (PAG)

 

WHEREAS:

3.  Interested parties who attended these meetings included:  municipal dischargers, storm water dischargers, industrial dischargers, irrigated agriculture representatives, forestry representatives, water purveyors, environmental groups, wildlife conservation groups, citizen monitoring groups, and public interest groups.

 

4.  The PAG will have 24 members representing the various interests, including 12 environmental groups and 12 regulated community representatives. 

 

5.  Future meetings of PAG will focus on critical issues pertaining to surface water quality monitoring programs and CWA Section 303(d), including issues related to Total Maximum Daily Loads (TMDLs).

 

6.  The SWRCB shall ensure that the advisory group meets in a manner that facilitates the effective participation of the public and stakeholder participants, including notification of meetings and agendas on the SWRCB web site.

 

THEREFORE BE IT RESOLVED THAT:

 

The SWRCB:

 

1.  Appoint the recommended individuals to form the PAG to advise the SWRCB with respect to the implementation of AB 982. 

 

2.  Delegate to the Executive Director authority for future membership and operating procedures for the PAG.

 

3.  Delegate to the Executive Director the authority to fill vacancies and replace PAG members for just cause.
