Any member of the public may address and ask questions of the Board relating to any matter within the State Water Board’s jurisdiction provided the matter is not on the State Water Board agenda, or pending before the California Water Boards.  Presentations at the Public Forum will be limited to 5 minutes or otherwise at the discretion of the Chairman.

4.  Consideration of a proposed Cease and Desist Order against Redwood Valley County Water District, which diverts water from the East Fork Russian River

WATER RIGHTS  (This is authorized under Government Code section 11126(c)(3).)

The Board will meet in closed session to deliberate on a proposed Cease and Desist Order following a hearing concerning Redwood Valley County Water District, which diverts water from the East Fork Russian River.

LITIGATION  (This is authorized under Government Code section 11126(e)(1).)

The Board will meet in closed session to discuss ongoing litigation in the cases of DeltaKeeper, et al. v. California Regional Water Quality Control Board- Central Valley, et al. (Sacramento County Superior Court, No. 04CS00235) and California Farm Bureau Federation v. California Regional Water Quality Control Board, Central Valley, et al. (Sacramento County Superior Court, No. 04CS00264).

The Board encourages submittal of written comments.  Unless otherwise specified, written comments must be submitted by 5:00 p.m., May 11, 2005 and will not be accepted after that time.  Agenda items will be electronically available May 9, 2005.  Time limitations on presentations may be imposed.  See “Presentations to the Board” at http://www.waterboards.ca.gov/board.html.

1.  Consideration of a resolution authorizing the Executive Director to sign a Cooperative Agreement with the Department of the Navy to provide regulatory oversight of site remediation activities at all Navy facilities.

2.  Consideration of a resolution approving an amendment to the Water Quality Control Plan for the Central Coast Region incorporating a total maximum daily load for pathogens in San Luis Obispo Creek

3.  Consideration of a resolution approving an amendment to the Water Quality Control Plan for the Santa Ana Region to incorporate nutrient total maximum daily loads for Lake Elsinore and Canyon Lake

ADMINISTRATION

4.  Consideration of a resolution amending the core regulatory program fee schedule (California Code of Regulations, Title 23, Division 3, Chapter 9, Article 1)

5.  Consideration of a resolution adding a fee schedule for agricultural waivers (California Code of Regulations,
Title 23, Division 3, Chapter 9, Article 1)
 Comments will only be considered on the changes discussed at the May 3, 2005 Board Workshop.

WATER QUALITY

6.  Consideration of a resolution adopting the regulations that defines the term “Interstitial Liquid Level Measurement” as used to describe a means of leak detection for underground storage tanks

7.  Consideration of an order in the matter of the Petitions of Olin Corporation and Standard Fusee, Inc., for review of Cleanup and Abatement Order No. R3-2004-0101 issued by the Central Coast Water Board, SWRCB/OCC Files A-1654 and A-1654(a)  (Written comments must be submitted by 5:00 p.m., May 16, 2005).

8.  Consideration of a Cease and Desist Order against Redwood Valley County Water District, which diverts water from the East Fork Russian River  (Note:  Parties may submit comments correcting factual errors or make arguments but no new evidence will be received during the Board meeting).
