This screening level assumes an average body weight of 70 kg and a consumption rate of 32 g/day for a 30 year exposure over a 70-year lifetime. This constituent is a carcinogen therefore the risk level is set to one in a million. A cooking reduction factor of 1 is applied for skin-off fillets.

Evaluation Guideline: The modified OEHHA Fish Contaminant Goal for total DDT in fish tissue is 15 ppb. This screening level assumes an average body weight of 70 kg and a consumption rate of 32 g/day for a 30 year exposure over a 70-year lifetime. This constituent is a carcinogen therefore the risk level is set to one in a million. A cooking reduction factor of 1 is applied for skin-off fillets.

Regional Board Staff Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.

Two lines of evidence, one each to evaluate the COLD and COMM beneficial uses, are available in the administrative record to assess this pollutant. None of the two samples exceeded the water quality objective.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used do not satisfy the data quantity requirements of section 6.1.5 of the Policy.
3. None of the two samples exceeded the guideline and the sample size is insufficient to determine with the power and confidence of the Listing Policy if standards are not met. A minimum of 16 samples is needed for application of table 3.1.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Staff Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.11 of the Listing Policy. Under this section when all other listing factors do not result in the listing of a water segment but information indicates non-attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates the water quality standard is not attained. If the weight of evidence indicates non-attainment, the water segment shall be placed on the section 303(d) list.

Two lines of evidence, are available in the administrative record to assess mercury concentrations in fish fillets. LOE # 46550 average fish tissue samples collected at a single site on the same day according to section 6.1.5 of the Listing Policy. One exceedance of one samples is not sufficient to support a listing based upon Section 3.1 of the Listing Policy, although a health advisory was issued.

Though the samples were collected from a single location on a single day, fish move throughout a lake and accumulate mercury in tissue over time. Therefore, spatial and temporal independence does not apply. A second line of evidence (LOE # 47542) presents total wet-weight mercury concentrations from 10 individual largemouth bass. Assessing these data according to Table 3.1 would be sufficient to support a listing.

Based on the readily available data and information, the weight of evidence indicates there is sufficient justification for placing this water segment-pollutant combination on the Section 303(d) list.


This conclusion is based on the following:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. There is 10 exceedance of 10 samples and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy.
4. The Office of Environmental Health Hazard Assessment (OEHHA) has issued a health advisory and guidelines for eating fish from Little Rock Reservoir due to high levels of mercury and PCBs. Refer to fish tissue info and resources for the Lahontan Region at http://www.waterboards.ca.gov/lahontan/water_issues/programs/swamp/index.shtm for a summary of the advisory and the background information (including associated sample results) and a description of how the guidelines were developed. Pursuant to section 3.4 of the Listing Policy, "a water segment shall be placed on the section 303(d) list if a health advisory against the consumption of edible resident organisms, has been issued by OEHHA or DHS."
5. This process is scientifically defensible and reproducible.
 
Regional Board Staff Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be placed on the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem.

Evaluation Guideline: The USEPA 304(a) recommended water quality criterion for concentrations of methylmercury in fish tissue of trophic level 4 fish (150 - 500 mm; fillet wet weight) is 0.2 mg/kg. Total mercury is usually analyzed for most fish studies and assumed to be 100 percent methylmercury for the purposes of risk assessment (Klasing & Brodberg 2008). The fish consumption rate of 32 g/day is considered more protective of human health since recommendations are now to eat one meal per week of fish to obtain necessary Omega-3 nutrition. The fish consumption rate of 32 g/day is also protective of wildlife, as it protects 6 out of 7 endangered species.

Regional Board Staff Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.

Two lines of evidence, one each to evaluate the COLD and COMM beneficial uses, are available in the administrative record to assess this pollutant. One sample was not used in the assessment because the laboratory data reporting limit(s) was above the objective and therefore the results could not be quantified with the level of certainty required by the Listing Policy to determine whether the one sample exceeded the water quality objective or not. The other sample associated with LOE 46552 did exceed the evaluation criteria for protection of COMM. Additionally, OEHHA has issued a fish consumption advisory for Littlerock Reservoir (in press) that will result in a listing for Littlerock Reservoir during this listing cycle. The samples results that support OEHHA's health advisory indicate 4 out of 7 fish tissue samples exceeded the evaluation criteria for protection of COMM.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. There is one exceedance of one sample associated with LOE 45662 and four exceedances of 7 samples associated with the data used to support the health advisory, and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. Additionally, OEHHA has issued a health advisory for Littlerock Reservoir which can be viewed at http://www.oehha.ca.gov/fish/so_cal/LittleRock.html. Regional Board Staff Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be placed on the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem.

State Water Board Review and Conclusion:

The April 19, 2010 State Water Board staff report for the 2010 Integrated Report recommended to place this water body on the 303(d) list for boron based on the State Water Board staff determination that the data were collected over a broad period of time to meet section 6.1.5.3 of the Listing Policy.

At the June 15, 2010 State Water Board meeting for approval of the 2010 Integrated Report, the State Water Board directed staff to reevaluate the listing recommendation for this water body - pollutant combination. Based on this reevaluation, State Water Board staff recommended the listing recommendation be revised to not place this water body-pollutant combination on the 303(d) list based on the minimum numbers of samples showing exceedence of the water quality objective.

On August 4, 2010 the State Water Board approved the staff recommendation to not place this water body-pollutant combination on the 303(d) list. The final language for the recommendation is the same as written under the "Regional Board Conclusion" above.

The Lahontan Basin Plan's narrative temperature objective is an antidegradation-based objective that requires that there be no change in temperature in waters designated for the Cold Freshwater Habitat (COLD) beneficial use. The objective does not include specific numerical limits for protection of the COLD use. Listing Policy Section 3.10 contains directions for assessment based on trends in water quality. These directions include requirements to establish specific baseline conditions and specify the influence of seasonal and interannual effects.

One line of evidence is available to support this decision. There are not enough temperature samples to establish baseline conditions (including diel, seasonal, annual and interannual variations in temperature) or to detect declining trends in the temperature regime if such trends exist.

Because temperature samples were collected only once or twice a year, weekly and monthly average data are not available for comparison with guidelines in the scientific literature for the temperature requirements of sensitive aquatic species such as salmonids, as directed in Listing Policy Section 6.1.5.9.

Data Used to Assess Water Quality: The U. S. Geological Survey took depth profile measurements of temperature in Littlerock Reservoir on four dates in 2001, 2002 and 2003. In 42 measurements, temperatures ranged from 8 to 17.5 degrees Celsius. The listing policy directs that multiple samples collected on the same date in the same location should be combined and represented by single value. Average temperatures in the depth profiles for the four sampling dates were 14. 7, 14.9, 15.2 and 8.9 degrees Celsius. (The reservoir was stratified on two dates and mixed on two dates.)

Sampling frequency was inadequate to characterize the natural temperature regime, including diel, seasonal and annual variation, or to detect whether changes in violation of the objective occurred.

Two lines of evidence are available in the administrative record to assess this pollutant. None of the samples exceed the Maximum Contaminant Level. The number of available annual average datapoints does not meet the minimum sample number requirement of Listing Policy Table 3.2.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfy the data quality requirements of section 6.1.4 of the Policy.
2. The data used do not satisfy the data quantity requirements of section 6.1.5 of the Policy. The limited sampling frequency (one or two sampling runs per year) was insufficient to document seasonal and annual variation.

State Board Review and Conclusion:

The April 19, 2010 State Water Board staff report for the 2010 Integrated Report
recommended to place this water body on the 303(d) list for manganese based on the State Water Board staff determination that the data were collected over a broad period of time to meet section 6.1.5.3 of the Listing Policy.

The State Water Board recommendation is based on the following:

Lahontan Regional Board staff had decided not to list this water body because staff thought it had insufficient information to make a decision to list. However, State Board staff finds there are 4 samples to make a decision and this meets the sample size requirements of Table 3.1 of the Listing Policy.

On August 4, 2010 the State Water Board approved the staff recommendation to place this water body-pollutant combination on the 303(d) list.
