Weight of Evidence:	This pollutant is being considered for removal from the section 303(d) list under section 4.3 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. 15 lines of evidence are available in the administrative record to assess this pollutant. LOE 385 was disassociated from this decision because LOE 27805, 27810, 27812, 27813, 27814, 27816, 27817, 27818, 27819, 27820, 27821, 27822, 27824, 27826, and 27828 encompassed the data from the older LOE in addition to including newer data. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. 20 of 84 samples at 72nd Place, 22 of 84 samples at 5th Place, 22 of 84 samples at 10th Place, 23 of 84 samples at 16th Place, 24 of 84 samples at Molino Ave, 19 of 85 samples at 36th Place, 29 of 84 samples at 3rd Place, 15 of 84 samples at Coronado Ave, 14 of 30 samples at east side of Belmont Pier, and 11 of 38 samples at west side of Belmont Pier exceeded the geometric mean bacteria objectives and this exceeds the allowable frequency listed in Table 4.2 of the Listing Policy. Additionally, 64 of 358 samples at 3rd Place, 27 of 122 samples at east side of Belmont Pier, and 35 of 134 samples at west side of Belmont Pier exceeded the single sample bacteria objectives and this exceeds the allowable frequency listed in Table 4.2 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

RWQCB Board Decision / Staff Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.
