Regional Board Staff Conclusion:	This pollutant is being considered for removal from the CWA section 303(d) List under section 4.3 of the Listing Policy. Under section 4.3 a single line of evidence is necessary to assess listing status. 7 lines of evidence are available in the administrative record to assess this pollutant. 0 of 0 samples exceeded the OBJECTIVE. 284 of 1177 samples exceeded the OBJECTIVE. 513 of 1163 samples exceeded the OBJECTIVE. 193 of 1178 samples exceeded the OBJECTIVE. 245 of 1164 samples exceeded the OBJECTIVE. 77 of 1178 samples exceeded the OBJECTIVE. 316 of 1164 samples exceeded the OBJECTIVE. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. 284 of 1177, 513 of 1163, 245 of 1164 and 316 of 1164 samples exceeded the OBJECTIVEs and this exceeds the allowable frequency listed in Table 4.2 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Regional Board Staff Conclusion:	This pollutant is being considered for removal from the section 303(d) list under section 4 of the Listing Policy. Under this section of the Policy, a minimum of one line of evidence is needed to assess listing status. The original line of evidence supporting the listing does not identify a pollutant but rather, a condition caused by a pollutant(s) (beach closures). The dry weather TMDL was approved by the RWQCB on 1/24/02, and the wet weather TMDL was approved on 12/12/04, and subsequently approved by USEPA on 6/19/03. These TMDLs are expected to address this water body condition. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of removing these listing from the 303(d) list because beach closures are not pollutants. Beach closure information should not be placed on the section 303(d) list because it is not a pollutant or toxicity (section 2 of the Listing Policy).
