2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. 2 of 2 samples exceeded the GUIDELINE. In addition, 2 of 2, 2 of 2, and 2 of 2 samples exceeded the CRITERIA and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Regional Board Staff Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4.1 of the Listing Policy. Under section 4.1 a single line of evidence is necessary to assess listing status.

1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. 2 of 2 samples exceeded the GUIDELINE. In addition, 5 of 5, 5 of 5, and 5 of 5 samples exceeded the CRITERIA and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

There is sufficient justification to place this waterbody/pollutant in the Being Addressed portion of the CWA 303(d) List because a TMDL has been completed and approved by USEPA, and is expected to result in attainment of the standard.

This conclusion is based on the staff findings that:
1. The Oxnard Drain No 3. Pesticides, PCBs and sediment toxicity TMDL was approved by USEPA on 10/06/2011.
 
Regional Board Staff Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

This conclusion is based on the staff findings that:
1. The Oxnard Drain No 3. Pesticides, PCBs and sediment toxicity TMDL was approved by USEPA on 10/06/2011.
 
Regional Board Staff Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

Data Used to Assess Water Quality: A TMDL has been approved for this water segment-pollutant combination. The Calleguas Creek Nitrogen TMDL was adopted by the Los Angeles RWQCB on October 24, 2002 and subsequently approved by USEPA. The TMDL was been integrated into the Basin Plan as Basin Plan Amendment 2002-017.

Oxnard Drain No. 3 is addressed in the staff report and the Basin Plan Amendment defines load allocations for oxidized nitrogen in ?other agricultural drains in the lower Calleguas watershed...? USEPA omitted the drain in the original approval letter and in a subsequent letter conferred approval of the TMDL for the drain.
