GLOSSARY
- Approval Date
- Adoption Date of the Water Board Order approving the project.
- Enhanced Compliance Action (ECA)
- The Water Boards may approve a settlement with a discharger that includes suspension of a portion of the monetary liability of a discretionary administrative civil liability (ACL) for completion of an Enhanced Compliance Actions (ECA). ECAs are projects that enable a Discharger to make capital or operational improvements to their facility beyond those required by law, and are separate from projects designed to merely bring a discharger into compliance.
- SEP/ECA Funding
- Portion of discharger's liability spent on the project. As a general rule, unless otherwise permitted by statute, only 50 percent of the total adjusted monetary assessment against the discharger may be spent on a SEP or ECA.
- Supplemental Environmental Project (SEP)
- The Water Boards may allow a discharger to satisfy part of the monetary assessment imposed in an administrative civil liability (ACL) order by completing or funding one or more Supplemental Environmental Projects (SEPs). SEPs are projects that enhance the beneficial uses of the waters of the State, have a nexus to the violation(s) cited in the ACL, that provide a benefit to the public at large and that, at the time they are included in the resolution of an ACL action, are not otherwise required of the discharger.

- Total cost to implement the project.
STATUS DEFINITIONS
- Satisfactory
- Project was completed in accordance with the specifications established in the Order.
- Unsatisfactory
- Project was not completed in accordance with specifications in the Order. Failure to satisfactorily complete any portion of a SEP or ECA results in the remaining suspended liability becoming immediately due and payable to the Cleanup and Abatement Account or other fund/account as authorized by statute.
