Regional Board Conclusion:	Fecal indicator bacteria (which includes enterococcus, fecal coliform, and total coliform) are being considered for removal from the Section 303(d) list under Section 4.3 of the Listing Policy. Under this section a single line of evidence (LOE) is necessary to assess listing status. Seven LOEs are available in the administrative record to assess indicator bacteria in this water body for the attainment of contact recreation standards. In addition two LOEs are available for total coliform for the attainment of shellfish harvesting standards. It should be noted that an additional three LOEs for total coliform data were not utilized in this decision because these bacteria are widespread in nature and occur in non-fecal sources such as soil and submerged wood and are not a good measure for the protection of contact recreation beneficial uses. However, the California Ocean Plan has specific total coliform objectives for waters designated for shellfish harvesting. 102 out 121 samples exceeded the total coliform objective of 70 MPN/100ml expressed as a 30 day rolling geometric mean. 63 of 161 samples exceeded the single sample SHELL objective of 230 MPN/100mL, which is below the exceedance threshold iterated in section 3.3 of the Listing Policy. In the 2010 Integrated Report, the data results for single sample maximum and geometric mean calculations were presented in the same LOE. In the 2006 and 2012 Integrated Reports, the data results for single sample maximum and geometric mean calculations are presented in separate LOEs. The following summary presents the total number of exceedances and total sample count from the three listing cycles combined, with single sample maximum values separate from geometric mean: 1) 22 of 281 samples exceed the single sample maximum objective for enterococcus; 2) 30 of 230 samples exceed the geometric mean objective for enterococcus; 3) 4 of 199 samples exceed the single sample maximum objective for fecal coliform; 4) Zero of 132 samples exceed the geometric mean objective for fecal coliform. The data assessed in this decision are ocean beach bacteria data collected in accordance with AB411 (Chapter 765, Statutes of 1997) requirements. In accordance with Section 4.3 of the Listing Policy, a 4% exceedance rate shall be used to remove waters to the List "if water quality monitoring was conducted April 1 through October 31 only". However, the data from the 2006, 2010, and 2012 Integrated Reports assessed in this decision include data collected during months outside the April - October range (Note: Data in the 2010 Integrated Report cycle was incorrectly evaluated at a 4% exceedance frequency). Therefore, this pollutant is being considered for removal from the section 303(d) list under section 4.2 of the Listing Policy, and waters should be removed from the list if less than or equal to: 1) 46 of 281 samples exceed the singles sample maximum objective for enterococcus; 2) 38 of 230 samples exceed the geometric mean objective for enterococcus; 3) 32 of 199 samples exceed the singles sample maximum objective for fecal coliform; 4) 21 of 132 samples exceed the geometric mean objective for fecal coliform. Neither the enterococcus nor the fecal coliform samples (both single samples and geomean values) violate the allowable 10% exceedance rate. While the Contact Recreation beneficial use appears to be protected, the Shellfish harvesting beneficial use is impaired. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list (i.e., sufficient justification to not delist). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. (3) Neither the enterococcus nor the fecal coliform samples exceed the objective more than the allowable frequency identified in Section 4.2 of the Listing Policy. (4) Total coliform samples related to the SHELL beneficial use exceed both objectives more that the allowable frequency identified in section 3.3 of the Listing Policy. (5) Pursuant to Section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the section 303(d) list because applicable water quality standards for the pollutant are not being exceeded.

State Board Staff Review of Regional Board Conclusion and Recommendation:	Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list (i.e., sufficient justification to not delist). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. (3) Neither the enterococcus nor the fecal coliform samples exceed the objective more than the allowable frequency identified in Section 4.2 of the Listing Policy. (4) Total coliform samples related to the SHELL beneficial use exceed both objectives more that the allowable frequency identified in section 3.3 of the Listing Policy. (5) Pursuant to Section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

State Board Decision Recommendation:	After review of this Regional Board decision, SWRCB staff recommend the following changes to the decision: The water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded for protection of the SHELL beneficial use.
