Regional Board Conclusion: Fecal indicator bacteria (which includes enterococcus, fecal coliform) are being considered for removal from the Section 303(d) list under Section 4.2 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. Eight lines of evidence are available in the administrative record to assess fecal indicator bacteria.

It should be noted that an additional three LOEs for total coliform data were not utilized in this decision because these bacteria are widespread in nature and occur in non-fecal sources such as soil and submerged wood and is not a good measure for the protection of contact recreation.

In the 2006 and 2010 Integrated Reports, the data results for single sample maximum and geometric mean calculations were presented in the same LOE. In the 2012 Integrated Report, the data results for single sample maximum and geometric mean calculations are presented in two separate LOEs. Additionally, in the 2006 Integrated Report enterococcus data was evaluated in the same LOE as fecal coliform data. The following summary presents the total number of exceedances and total sample count from the two listing cycles combined, for single sample maximum separate from geometric mean: 1) 109 of 389 samples exceed the singles sample maximum objective for enterococcus; 2) 118 of 286 samples exceed the geometric mean objective for enterococcus; 3) 64 of 389 samples exceed the singles sample maximum objective for fecal coliform; 4) 45 of 134 samples exceed the geometric mean objective for fecal coliform. For the protection of the shellfish harvesting beneficial use, 41 of 126 samples exceeded the single sample objective for fecal coliform, which is more than the allowable exceedance frequency in Section 4.3 of the Listing Policy.

The data assessed in this decision are ocean beach bacteria data collected in accordance with AB411 (Chapter 765, Statutes of 1997) requirements. In accordance with Section 4.3 of the Listing Policy, a 4% exceedance rate shall be used to remove waters to the List "if water quality monitoring was conducted April 1 through October 31 only". However, the data assessed in this decision include data collected during months outside the April - October range. Therefore, this pollutant is being considered for removal from the section 303(d) list under section 4.2 of the Listing Policy, and waters should be removed from the list if less than or equal to: 1) 64 of 389 samples exceed the singles sample maximum objective for enterococcus; 2) 47 of 286 samples exceed the geometric mean objective for enterococcus; 3) 64 of 389 samples exceed the singles sample maximum objective for fecal coliform; 4) 44 of 134 samples exceed the geometric mean objective for fecal coliform. The enterococcus samples (both single samples and geomean values) violate the allowable exceedance rate. The fecal coliform single samples did not, while the fecal coliform geomean values did violate the exceedance rate.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list (i.e., sufficient justification to not de-list). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. (3) Enterococcus single sample and geometric mean values, as well as the Fecal Coliform geometric mean values, exceed the objectives more than the allowable frequency identified in Section 4.2 of the Listing Policy. (4) The fecal coliform single samples related to the protection of shellfish harvesting, exceeded the objective more than the allowable frequency identified in Section 4.2. (5) Pursuant to Section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.
 
Regional Board Decision Recommendation: After review of the available data and information, North Coast RWQCB staff concludes that the water body-pollutant combination should not be removed from the Section 303(d) List because applicable water quality standards for the pollutant are being exceeded.
 
State Board Staff Review of Regional Board Conclusion and Recommendation: Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list (i.e., sufficient justification to not de-list). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. State Board Decision Recommendation: After review of the available data and information, SWRCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.
