Regional Board Conclusion: This pollutant is being considered for removal from the Section 303(d) List under Section 4.2 of the Listing Policy. Under this section of the Policy, a minimum of one line of evidence is needed to assess listing status. Five lines of evidence are available in the administrative record.

There is only one sample from Potato Creek (LOE 44091), Monroe Creek (LOE 43801), and Miner’s Creek (LOE 44092) and these sample sizes are not sufficient to determine with the power and confidence of the Listing Policy if the cold freshwater habitat (COLD) beneficial use is being protected, as a minimum of 26 samples is needed for application of Table 4.2.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. (3) 303(d) listing determinations made prior to 2006 were not held in an assessment database. LOE 4782 is a placeholder for the 303(d) listing data and information from a previous assessment cycle that was initially utilized to make this listing determination. (4) Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Evaluation Guideline: EVIDENCE OF ALTERATION OF NATURAL RECEIVING WATER TEMPERATURES (NON-NATURAL TEMPS): The water temperatures of the Trinity River HU, South Fork HA do not reflect natural conditions as environmental factors that influence water temperature have been altered, such as riparian shade removal and increased sediment loading (USEPA 1998). EVIDENCE OF SALMONID PRESENCE & LIFE CYCLE USE: Coho, steelhead, and Chinook are present in the watershed (USEPA 1998). Steelhead rearing occurrs during all months of the year and spawning occurrs February through April. Spawning for coho and Chinook occurrs September to November (USFWS et al. 2004). The mainstem South Fork Trinity River supports non-core rearing while the tributaries support core rearing.

Under Section 3.1, a single line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant. No new data were assessed during the current Integrated Report cycle, however it should be noted that the use rating and decision language have been altered to reflect that there are insufficient data available to make a listing determination.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. (3) Zero of the 15 samples exceeded the aluminum objective, and this sample size is insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (A) 16 samples, or (B) greater than or equal 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1 (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

(2) The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. (3) Zero of 15 samples from the South Fork Trinity River and zero of one sample from each of Miners Creek, Potato Creek, and Monroe Creek exceed the objective, however these sample sizes are insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (1) 26 samples, or (2) greater than or equal to 5 exceedances of the objective with less than 26 samples is needed for application of Table 3.2. Under Section 3.1, a single line of evidence is necessary to assess listing status. Three lines of evidence are available in the administrative record to assess this pollutant: one for Miners Creek (LOE 44046), one for Monroe Creek (LOE 43988), and one for Potato Creek (LOE 44045).

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the Section 303(d) List in the Water Quality Limited Segments category (i.e., sufficient justification to not list). Under section 3.2 a minimum of one line of evidence is necessary to assess listing status. Three lines of evidence are available in the administrative record to assess this pollutant.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of section 6.1.4 of the Policy. (2)The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. (3) Zero of one sample from Monroe Creek (LOE 33911), zero of one sample from Miner’s Creek (LOE 33988), and one of one sample from Potato Creek (LOE 33989) exceed the objective, and these sample sizes are insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (A) 26 samples, or (B) greater than or equal 5 exceedances of the objective with less than 26 samples is needed for application of Table 3.2. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

These pollutants are being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant. None of the samples in LOE #30172 exceed the water quality objective.The pollutants in LOE #30067 do not have water quality objectives and, therefore, a decision could not be made. The samples were analyzed for 95 pesticides, pesticide constituents, isomers, or metabolites. For each of the 95 pesticide analytes, 8 to 9 samples were collected. The samples were collected as part of the Surface Water Ambient Water Monitoring Program (SWAMP). The data are found in the 5-Year Monitoring Report (NCRWQCB 2008). This pollutant is being considered for placement on the Section 303(d) List under Section 3.1 of the Listing Policy. Under Section 3.1, a single line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant. None of the 400 polychlorinated biphenyl (PCB) samples exceed the evaluation guideline. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. (3) None of the 400 samples exceeded the PCB evaluation guideline used to interpret the water quality objective, and this does not exceed the allowable frequency of 35 per the binomial distribution described in Section 3.1 of the Listing Policy. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
