Regional Board Conclusion:	This pollutant is being considered for placement on the Section 303(d) List under Section 3.1 of the Listing Policy. Under Section 3.1, a single line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant. No new data were assessed during the current Integrated Report cycle, however it should be noted that the use rating and decision language have been altered to reflect that there are insufficient data available to make a listing determination. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. (3) Zero of the 2 samples exceeded the aluminum objective, and this sample size is insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (A) 16 samples, or (B) greater than or equal 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1 (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Conclusion:	Fecal indicator bacteria (which includes E. coli and fecal coliform) are being considered for placement on the Section 303(d) list under Section 3.2 and 3.3 of the Listing Policy. Under these sections a single line of evidence (LOE) is necessary to assess listing status. Four lines of evidence are available in the administrative record to assess indicator bacteria in this water body. In accordance with Section 3.3 of the Listing Policy, a 4% exceedance rate shall be used to add waters to the List "if water quality monitoring was conducted April 1 through October 31 only". The E. coli data collected in Bulwinkle Creek (LOE 31862), an unnamed tributary (LOE 31863), and the Little River (LOE 47494) were collected during this timeframe only. Two of two E. coli samples from Bulwinkle Creek and two of two E. coli samples from the unnamed tributary violate the evaluation guideline, however these sample sizes are insufficient to determine with the power and confidence of the listing policy if standards are being met as there must be either (1) at least 22 samples available for evaluation in order to make a listing determination or (2) 3 or more exceedances from less than 22 samples in which case listing can occur. Four of 8 E. coli samples collected in the Little River exceed the evaluation guideline and this violates the allowed 4% exceedance frequency. The fecal coliform data assessed in LOE 31829 for the Little River includes data collected during months outside the April - October range. Therefore, the fecal coliform data from the Little River is being considered under section 3.2 of the Listing Policy, using a 10% exceedance rate. One of 8 fecal coliform samples from the Little River exceed the evaluation guideline, and this sample size is insufficient to determine with the power and confidence of the listing policy if standards are being met as there must be either (1) at least 26 samples available for evaluation in order to make a listing determination under section 3.2 or (2) 5 or more exceedances from less than 26 samples in which case listing can occur. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for adding the Little River to the Section 303(d) list for fecal indicator bacteria (i.e., sufficient justification to list). This conclusion is based on the staff findings that: (1) The data used satisfy the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfy the data quantity requirements of Section 6.1.5 of the Policy. (3) Four of 8 E. coli samples from the Little River exceed the objective and this violates the allowable 4% exceedance frequency from the Listing Policy. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the Little River should be placed on the section 303(d) list for Indicator Bacteria because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem.
