Regional Board Conclusion:	Region 8 data was not included in the 2012 Integrated Report so all decisions are carried over from the 2010 listing cycle. This pollutant is being considered for removal from the section 303(d) list under section 4.3 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. Five (5) lines of evidence are available in the administrative record to assess this pollutant. Each line of evidence represents a station that was sampled. One thousand seventy-six samples exceeded the water quality objective. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. One thousand seventy-six of 10,244 samples exceeded the Ocean Plan standard and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Under this section a single line of evidence is necessary to assess listing status. Eight (8) lines of evidence are available in the administrative record to assess this pollutant. Each line of evidence represents a station that was sampled. Ninety-three (93) of samples analyzed for fecal coliform and 67 samples analyzed for total coliform exceeded the water quality objectives for fecal and total coliform respectively. Please note that indicator bacteria was previously called pathogens. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Ninety-three of 9276 fecal coliform samples and 67 of 13792 total coliform samples exceeded the Ocean Plan standards for fecal and total coliform respectively and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy. 4. (A) 1,000 total coliform bacteria per 100 milliliters, if the ratio of fecal/total coliform bacteria exceeds 0.1; or
(B) 10,000 total coliform bacteria per 100 milliliters; or
(C) 400 fecal coliform bacteria per 100 milliliters; or
(D) 104 enterococcus bacteria per 100 milliliters.

This pollutant is being considered for placement on the section 303(d) list under section 3.5 of the Listing Policy. One line of evidence is available in the administrative record to assess this pollutant. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Four of the 6 samples exceeded the OEHHA Screening Value and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
