No new information was reviewed for this current Integrated Report cycle. Therefore, the previous conclusion remains unchanged, and is as follows:

This pollutant is being considered for placement on the Section 303(d) List under Section 3.1 of the Listing Policy. Under Section 3.1, a single line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant. None of the 17 aluminum samples exceed the water quality objective. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. (3) None of the 17 samples exceeded the aluminum objective, and this does not exceed the allowable frequency listed in Table 3.1 of the Listing Policy. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.9 of the Listing Policy. Under section 3.9, lines of evidence associating the benthic community effects with water or sediment concentrations of pollutants are necessary to assess listing status. One line of evidence for Root Creek (Eel River HU, Van Duzen River HA) for each of eleven (11) pollutants is available in the administrative record:
(a) 0 of 1 sample for Benthic Macroinvertebrate Bioassessment did not meet the North Coast Index of Biotic Integrity (IBI);
(b) 0 of 1 sample each for temperature, pH, dissolved oxygen, specific conductance, total dissolved solids, chloride, and sulfate did not meet water quality objectives;
(c) 0 of 1 sample each for ammonia-nitrogen, nitrite-nitrogen, and nitrate-nitrogen did not meet water quality objectives.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing Benthic Macroinvertebrate Bioassessment in this water body on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that:
(1) The data used satisfy the data quality requirements of section 6.1.4 of the Policy;
(2) The data used satisfy the data quantity requirements of section 6.1.5 of the Policy;
(3) The sample size for temperature, specific conductance, total dissolved solids, chloride, sulfate, dissolved oxygen and pH is insufficient to determine with the power and confidence of the Listing Policy if standards are not met per Table 3.1 of the Policy;
(4) The sample size for ammonia-nitrogen, nitrite-nitrogen, and nitrate-nitrogen is insufficient to determine with the power and confidence of the Listing Policy if standards are not met per Table 3.2 of the Policy;
(5) The single Benthic-Macro-Invertebrate bioassessment sample met the evaluation guideline, however this sample size is insufficient to determine with the power and confidence of the Listing Policy if standards are not met. Additionally, no pollutant could be associated directly with the non-attainment of the Benthic Macroinvertebrate Bioassessment as sample sizes were all insufficient;
(6) Therefore, this information is insufficient to determine if standards are being met with the confidence and power required by the Policy, since Section 3.9 of the Policy states that the bioassessment data must be associated with exceedances of numerical water quality objectives; and
(7) Pursuant to section 3.11 of the Policy, no additional data and information are available indicating that standards are not met.

Water Quality Objective/Criterion: Per the Basin Plan (NCRWQCB 2011): All waters shall be maintained free of toxic substances in concentrations that are toxic to, or that produce detrimental physiological responses in human, plant, animal, or aquatic life. Salinity data (ppt) were converted to Total Dissolved Solids (mg/L) so that the data could be compared to the Secondary MCL for TDS (1ppt = 1000 mg/L). For Total Dissolved Solids (TDS), the secondary MCL recommended range is 500 mg/l, the upper range is 1000 mg/l, and the short term range is 1500 mg/l. The recommended range of 500 mg/L was used for the purpose of this assessment.

Regional Board Conclusion: This pollutant is being considered for placement on the Section 303(d) List under Section 3.2 of the Listing Policy. Under Section 3.2, a single line of evidence is necessary to assess listing status. One line of evidence is available to assess protection of the municipal and domestic supply (MUN) beneficial use in the mainstem Van Duzen River (LOE 46924), one line of evidence is available to assess protection of the MUN beneficial use in Yager Creek (LOE 46925), and one line of evidence is available to assess protection of the MUN beneficial use in Root Creek (LOE 44111). It should be noted that data from LOE 25433 from the 2010 Integrated Report cycle were re-evaluated this current cycle in LOEs 46924 and 46925.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. (3) Zero of 12 samples from the mainstem Van Duzen River, zero of 5 samples from Yager Creek, and zero of one sample from Root Creek exceed the objective, however these sample sizes are insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (1) 26 samples, or (2) greater than or equal to 5 exceedances of the objective with less than 26 samples is needed for application of Table 3.2. Under Section 3.1, a single line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant in Root Creek (LOE 44009).

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the Section 303(d) List in the Water Quality Limited Segments category (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. (3) Zero of one sample from Root Creek exceeds the water quality objective, however this sample size is insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (a) 16 samples, or (b) greater than or equal to 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1. This pollutant is being considered for listing under Section 2.2 of the Listing Policy. Under this section of the Policy, a minimum of one line of evidence is needed to assess listing status.

The Van Duzen River and Yager Creek Total Maximum Daily Load for Sediment was established by US EPA on December 16, 1999.

Based on the readily available information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list.
