Regional Board Staff Conclusion:	Fecal indicator bacteria (which includes enterococcus, fecal coliform) are being considered for removal from the Section 303(d) list under Section 4.2 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. Six lines of evidence are available in the administrative record to assess indicator bacteria in this water body for the attainment of water contract recreation (REC-1) standards. Additionally, one LOE is available for total coliform for the attainment of shellfish harvesting (SHELL) standards. Data from LOE 343 were re-evaluated with LOE 133865. Data from LOE 8831 were re-evaluated with LOEs 133703 and 133704. Data from LOE 32677 were re-evaluated with LOE 133703. Data from LOE 44728 were re-evaluated with LOE 133704. LOEs 133703 and 133704 will not be included in the final use rating because the same data are evaluated at 10% by LOEs 133623 and 133593. In the 2006 and 2010 Integrated Reports, the data results for single sample maximum and geometric mean calculations were presented in the same LOE. In the 2012 Integrated Report, the data results for single sample maximum and geometric mean calculations are presented in two separate LOEs. Additionally, in the 2006 Integrated Report enterococcus data was evaluated in the same LOE as fecal coliform data and in 2018 the statistical threshold value is being used to with the geomean to evaluate data. The following summary presents the total number of exceedances and total sample count from the three listing cycles combined, for single sample maximum separate from geometric mean: 1) 52 of 134 samples exceed the Statistical Threshold Value objective for the REC-1 for enterococcus; 2) 107 of 421 samples exceed the geometric mean objective for the REC-1 beneficial use for enterococcus; 3) 48 of 310 samples exceed the singles sample maximum objective for REC-1 for fecal coliform; 4) 57 of 196 samples exceed the geometric mean objective for REC-1 for fecal coliform. For the protection of the shellfish harvesting beneficial use 146 of 520 samples exceeded the median concentration objective for total coliform, which is more than the allowable exceedance frequency in Section 4.3 of the Listing Policy. The data assessed in this decision are ocean beach bacteria data collected in accordance with AB411 (Chapter 765, Statutes of 1997) requirements. In accordance with Section 4.3 of the Listing Policy, a 4% exceedance rate shall be used to remove waters to the List "if water quality monitoring was conducted April 1 through October 31 only". However, the data assessed in this decision include data collected during months outside the April - October range. Therefore, the samples are being compared against a 10% exceedance rate. The enterococcus samples (single samples, statistical threshold value, and geomean values) violate the allowable exceedance rate. The fecal coliform samples (both single samples and geomean) violate the allowable exceedance rate. The total coliform samples, (median concentration for SHELL only) violate the allowable exceedance rate. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) list. This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. (3) Enterococcus single sample and geometric mean values, as well as the Fecal Coliform single sample and geometric mean values, exceed the objective for the protection of REC-1 more than the allowable frequency identified in Section 4.2 of the Listing Policy. (4) The total coliform samples related to the protection of shellfish harvesting, exceeded the objective more than the allowable frequency identified in Section 4.2. (5) Pursuant to Section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are me
