Regional Board Staff Conclusion: On March 22, 2019 the U.S. EPA approved amendments to update the bacterial objectives for Inland Surface Waters, Enclosed Bays, and Estuaries. Therefore, this pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy utilizing the new objective. Under this section a single line of evidence is necessary to assess listing status.
Ten lines of evidence are available in the administrative record to assess this pollutant. An additional E.coli LOE (46998) was not utilized in this assessment as these data were either deemed unsuitable or were re-evaluated and are summarized in the other LOEs associated with this decision. LOE 47598 cites findings from a draft version of the TMDL which have since been updated and thus it is not used in this decision.
Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing the Lower Santa Rosa Creek HUC-12 and Upper Santa Rosa Creek HUC-12 on the CWA section 303(d) List for Indicator Bacteria. This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. The impairment analysis utilized a 10% exceedance frequency for year-round and winter data analysis and a 4% exceedance frequency was utilized during the summer months. Thus, a minimum of 26 samples or 5 exceedances were required to calculate year-round or winter impairment and a minimum of 22 samples or 3 exceedances to calculate summer impairment.
4. The statewide objective for E.coli bacteria in freshwater (salinity equal to or less than 1 ppth 95% or more of the time during the calendar year) was used to assess impairment/pollution, applying the exceedance thresholds from the 303 (d) Listing Policy. If E.coli bacteria data exceeded the objective more than the allowable frequency in the Listing Policy, the HUC-12 was identified as impaired.
5. Water bodies were also identified as impaired using a weight of evidence approach if enterococci data from freshwater exceeded the USEPA Criteria more than the allowable frequency in the Listing Policy AND a public health advisory was posted at any recreational beach in the HUC-12 during 2013-2016.
6. Fifty-five of 57 geometric means and 40 of 50 STVs for E.coli calculated from year-round data in the Lower Santa Rosa Creek HUC-12 exceed the objective and this exceeds the allowable frequency from the Listing Policy. Additionally, 13 of 16 winter STV and 27 of 34 summer STV for E.coli exceed the objective, and this exceeds the allowable frequency from Table 3.2 of the Listing Policy. The Santa Rosa Creek at Prince Memorial Greenway, which lies within the Lower Santa Rosa Creek HUC-12 just downstream of the Upper Santa Rosa Creek HUC-12, has a permanent public health advisory posted and thirty-seven of 42 geometric mean and 29 of 42 STV for Enterococcus in the Lower Santa Rosa Creek HUC-12 exceed the USEPA criteria. Bacteroides and DNA data provided evidence of human and bovine/grazer fecal waste as sources of concern in the Lower Santa Rosa Creek HUC-12.

7. Twenty-two of 26 geometric means and 7 of 13 STV for E.coli calculated from year-round data in the Upper Santa Rosa Creek HUC-12 exceed the objective and this exceeds the allowable frequency from the Listing Policy. Additionally, 30 of 34 summer geometric means for E.coli exceed the objective and this exceeds the allowable frequency from Table 3.2 of the Listing Policy. The Santa Rosa Creek at Prince Memorial Greenway, which lies immediately downstream of the Upper Santa Rosa Creek HUC-12, has a permanent public health advisory posted and 10 of 11 geometric mean and 9 of 11 STV for Enterococcus calculated from year-round data in the Upper Santa Rosa Creek HUC-12 exceed the USEPA criteria.
8. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Staff Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the Lower Santa Rosa Creek HUC-12 and Upper Santa Rosa Creek HUC-12 should not be removed from the section 303(d) list for Indicator Bacteria because applicable water quality standards for the pollutant are being exceeded.

Data Used to Assess Water Quality: Detectable levels of non-natural (e.g. human or bovine) pathogen indicator bacteria are in violation of the Basin Plan bacterial Water Quality Objective. Russian River Pathogen Indicator Bacteria TMDL results reflect that both human-host and bovine-host Bacteroides bacteria have been detected in surface waters throughout Russian River Watershed. E. Coli data from the mainstem Laguna de Santa Rosa and Green Valley Creek violate the objective. PhyloChip data results reflect the presence of human host pathogens in the Russian River watershed. Therefore, it is concluded that natural background levels of bacteriological quality are not being achieved in the Russian River watershed and are in violation of the Basin Plan narrative bacteria Water Quality Objective.

Evaluation Guideline: Physical characteristics of a site vary due to both natural factors and human disturbance. Statistical models based on a large statewide reference data set can help distinguish natural variability from anthropogenic stress. These models work across the diverse stream types found in California. The Index of Physical Habitat Integrity (IPI) is a multimetric Index developed based on these models to characterize physical habitat condition for streams in California. Index scores near 1 indicate physical habitat conditions similar to reference, whereas lower scores indicate degradation. For the purposes of making statewide assessments, three thresholds (analogous to those used for the CSCI) were established based on the 30th; 10th; and 1st percentiles of IPI scores at reference sites. These three thresholds divide the IPI scoring range into 4 categories of physical condition as follows: greater than or equal to 0.94 = likely intact condition; 0.93 to 0.84 = possibly altered condition; 0.83 to 0.71 = likely altered condition; less than or equal to 0.70 = very likely altered condition. Evaluation Guideline: The California Stream Condition Index (CSCI) is a biological scoring tool that helps aquatic resource managers translate complex data about benthic macroinvertebrates found living in a stream into an overall measure of stream health. The CSCI score is calculated by comparing the expected condition with actual (observed) results (Rhen, A.C. et al., 2015). CSCI scores range from 0 (highly degraded) to greater than 1 (equivalent to reference). Data included in this decision were originally assessed under the "Russian River HU, Middle Russian River HA, Santa Rosa Creek" water body, which has been split into two water bodies for the current Integrated Report cycle: (1) Russian River HU, Middle Russian River HA, Santa Rosa HSA, mainstem Santa Rosa Creek and (2) Russian River HU, Middle Russian River HA, Santa Rosa HSA, tributaries to Santa Rosa Creek.

LOEs 46960 and 46959 replace LOE 6193 from the 2010 Integrated Report cycle. Data from the original LOE were split into two LOEs in order to assess mainstem Santa Rosa Creek data in a separate LOE from data for tributaries to Santa Rosa Creek. LOE 46960 is assessed under this water body, and LOE 46959 is assessed under the "Russian River HU, Middle Russian River HA, Santa Rosa HSA, mainstem Santa Rosa Creek" water body. Although there are no new data for this water segment-pollutant combination for the current Integrated Report cycle, the decision information has changed since the 2010 Listing cycle, in order to reflect the decrease in the number of samples resulting from the removal of data for the mainstem Santa Rosa Creek to a separate decision.

This pollutant is being considered for placement on the Section 303(d) List under Section 3.1 of the Listing Policy. Under Section 3.1, a single line of evidence is necessary to assess listing status. No new information was reviewed for this current assessment cycle. However, three LOEs for Spring Lake were removed from this Decision and are now evaluated under the Spring Lake waterbody (LOEs 47060, 47063, and 47065). However, the previous cycles conclusion remains unchanged.

This pollutant is being considered for placement on the Section 303(d) List under Section 3.1 of the Listing Policy. Under Section 3.1, a single line of evidence is necessary to assess listing status. Two lines of evidence are available to assess protection of the cold freshwater habitat (COLD) beneficial use.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. (3) One of one sediment sample exceeds the evaluation guideline for COLD and that sediment sample exhibits toxicity. These sample sizes are insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (A) 16 samples, or (B) greater than or equal 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Data included in this decision were originally assessed under the "Russian River HU, Middle Russian River HA, Santa Rosa Creek" water body, which has been split into two water bodies for the current Integrated Report cycle: (1) Russian River HU, Middle Russian River HA, Santa Rosa HSA, mainstem Santa Rosa Creek and (2) Russian River HU, Middle Russian River HA, Santa Rosa HSA, tributaries to Santa Rosa Creek.

LOE 47002 and LOE 47003 replace LOE 6197 from the 2010 Integrated Report cycle. Data from the original LOE were split into two LOEs in order to assess mainstem Santa Rosa Creek data in a separate LOE from data for tributaries to Santa Rosa Creek. LOE 47003 is assessed under this water body, and LOE 47002 is assessed under the "Russian River HU, Middle Russian River HA, Santa Rosa HSA, mainstem Santa Rosa Creek" water body. LOE 47031 contains new data for this water segment-pollutant combination for the current Integrated Report cycle.

Regional Board Staff Conclusion: These pollutants are being considered for placement on the Section 303(d) List under Section 3.1 of the Listing Policy. Under Section 3.1, a single line of evidence is necessary to assess listing status. Twenty-one lines of evidence are available to assess protection of the cold freshwater habitat (COLD) beneficial use, twenty lines of evidence are available to assess protection of the warm freshwater habitat (WARM) beneficial use, and seven lines of evidence are available to assess protection of the commercial and sport fishing (COMM) beneficial use.

Per the Listing Policy, data from LOEs 47028, 47038, 47057, and 47066 could not be evaluated because the laboratory data reporting limit(s) were above the objectives and therefore the results could not be quantified with the level of certainty required by the Listing Policy.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. (3) Zero of one sediment sample for each of Cyfluthrin, Lambda Cyhalothrin, Cypermethrin, Deltamethrin, Dieldrin, Endrin, Esfenvalerate/Fenvalerate, Fenpropathrin, Fipronil, Fipronil Sulfide, Fipronil Sulfone, Lindane/gamma Hexachlorocyclohexane (gamma-HCH), and Total Permethrin exceed both the WARM and COLD water quality objective, however these sample sizes are insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (a) 16 samples, or (b) greater than or equal to 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1. (4) Zero of one fish tissue sample for each of Aldrin, Dieldrin, Endrin, Hepatachlor, Hepatachlor exoxide, Lindane/gamma Hexachlorocyclohexane (gamma-HCH), and alpha-Endosulfan (Endosulfan 1) exceed both the WARM and COLD water quality objective, however these sample sizes are insufficient to determine with the power and confidence of the Listing Policy if standards are not met, as a minimum of either (a) 16 samples, or (b) greater than or equal to 2 exceedances of the objective with less than 16 samples is needed for application of Table 3.1. Spatial Representation: Data for this line of evidence for Spring Lake (Santa Rosa Creek Reservoir) was collected at 1 monitoring site [ Spring Lake - 114PSP009]. Samples were collected from 1 location. Individual sample locations consisted of an area within a given waterbody from which fish tissue samples were collected. The number of sample locations per waterbody was based on the overall size of the waterbody (SWAMP, 2010). LOEs 47358 and 46977 replace LOE 6192 from the 2010 Integrated Report cycle. Data from the original LOE were split into two LOEs in order to assess mainstem Santa Rosa Creek data in a separate LOE from data for tributaries to Santa Rosa Creek. LOE 47358 is assessed under this water body, and LOE 46977 is assessed under the "Russian River HU, Middle Russian River HA, Santa Rosa HSA, mainstem Santa Rosa Creek" water body. Although there are no new data for this water segment-pollutant combination for the current Integrated Report cycle, the decision information has changed since the 2010 Listing cycle, resulting from the removal of data for the mainstem Santa Rosa Creek to a separate decision.

This pollutant is being considered for placement on the Section 303(d) List under Section 3.1 of the Listing Policy. Under Section 3.1 a single line of evidence is necessary to assess listing status. One line of evidence is available in the administrative record to assess this pollutant. It is unknown if any of the phosphorus samples exceed the water quality objective as there is insufficient information available to determine exceedance. Specifically, the samples cannot be compared to the objective because diel samples for dissolved oxygen (DO), pH, and/or chlorophyll-a are not available. Nutrients such as phosphorus do not impair beneficial uses by themselves, or cause non-attainment of the objective. Rather, they cause indirect impacts through algal growth and extreme diel patterns for DO and pH, which then impair uses. Waterbody-specific factors such as riparian cover, flow conditions, and stream channel configuration also affect how nutrients are processed within the stream and play a large role in determining whether or not nuisance algal conditions will prevail. For these reasons, comparing a single nutrient value to the biostimulatory objective is not recommended. Instead, nutrient-related indicator parameters, such as diel measurements of DO, pH, and/or chlorophyll-a, should be evaluated to determine attainment of the objective and protection of beneficial uses. When nutrient-related indicator parameters exceed targets, nutrient concentrations will then be analyzed to determine whether phosphorus should be added to a possible listing under the 303(d) List. Therefore, the weight of evidence indicates that there is insufficient information available to determine if it is appropriate to place this water segment-pollutant combination on the Section 303(d) List in the Water Quality Limited Segments category. This conclusion is also based on the staff findings that: (1) The data used satisfies the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfies the data quantity requirements of Section 6.1.5 of the Policy. (3) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
