Regional Board Conclusion: Fecal indicator bacteria (which includes enterococcus, fecal coliform, and total coliform) are being considered for listing in the CWA Section 303(d) list under Section 3.3 of the Listing Policy. Under this section a single line of evidence (LOE) is necessary to assess listing status. Five LOEs are available in the administrative record to assess indicator bacteria in this water body for the attainment of water contact recreation (REC-1) standards. Additionally, one LOE is available for total coliform for the attainment of shellfish harvesting (SHELL) standards.

Data from LOE 44729 were re-evaluated with LOE 133681. Data from LOEs 344 and 32707 were re-evaluated with LOE 133697. Data from LOE 8885 and 46780 were re-evaluated using LOEs 133681 and 133697. LOE 344 was not used in assessment as the data were assessed under a standard that has since been superseded (California Ocean Plan, 2018). Data from LOE 8882 were re-evaluated with LOE 46781. Data from LOEs 47625 and 47626 were re-evaluated with LOE 133605.

In accordance with Section 3.3 of the Listing Policy, a 4% exceedance rate shall be used to add waters to the List "if water quality monitoring was conducted April 1 through October 31 only." However, data exist outside of that date range; therefore a 10% exceedance rate shall be used to assess this waterbody, per Section 3.3 of the Listing Policy. LOEs 133697 and 133681 were not used in this assessment as they were evaluated at a 4% exceedance rate.

The following summary presents the total number of exceedances and total sample count from the listing cycles combined: 1) 8 of 116 samples exceed the Statistical Threshold Value (STV) objective for enterococcus; 2) 6 of 376 samples exceed the geometric mean objective for enterococcus; 3) 0 of 181 samples exceed the single sample maximum objective for fecal coliform; 4) 0 of 117 samples exceed the geometric mean objective for fecal coliform. For assessing SHELL beneficial use, 10 of 463 samples exceed the median concentration objective for total coliform.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against adding this water segment-pollutant combination to the CWA Section 303(d) list. This conclusion is based on the staff findings that: (1) The data used satisfy the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfy the data quantity requirements of Section 6.1.5 of the Policy. (3) Enterococcus, fecal coliform, and total coliform samples do not exceed the objectives more than the allowable frequency identified in Sections 3.3 of the Listing Policy. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. All beneficial uses are full supported in this waterbody.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because applicable water quality standards are not being exceeded.
