Regional Board Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4.2 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.

The original decision to list San Vicente Creek for Sedimentation is inconsistent with the Listing Policy and evaluation of the complete data set and new data indicate that beneficial uses are supported. This conclusion is based on the following supporting evidence:
First, the original decision to add the water segment to the CWA section 303(d) List was based on a partial data set (summarized in LOE 1835) and when combined with the complete data set for the period of record (LOEs 1835 and 30273), the decision should have been ¿Do Not List¿. Based on the available data (49 months of daily turbidity measurements), 158 of the 1483 samples exceed the water quality objective (Drinking Water MCL of 5 NTU's) and this does not exceed the allowable frequency listed in Tables 3.2 or 4.2 of the Listing Policy. Furthermore, when dry weather months are excluded (June, July, August, and September) from this assessment, there are a total of 1027 samples with 157 exceedances of the Drinking Water MCL and again supports the removal of this water segment / pollutant combination from the 303(d) List.

Second, the original decision to add the water segment to the CWA section 303(d) List was supported by the habitat typing data presented in LOE # 1838. However, these data do not meet the following criteria of the Listing Policy and therefore can not be used alone to support a listing for sedimentation:
1. Section 3.8 of the Listing Policy states "For adverse biological response related to sedimentation, the water segment shall be placed on the section 303(d) list if adverse biological response is identified and effects are associated with clean sediment load..."

Based on the data and information provided, no adverse biological response has been identified. Furthermore, a recent publication ¿Steelhead/Rainbow Trout (Oncorhynchus mykiss) Resources South of the Golden Gate, California (Becker and Reining, 2008) discusses two recent fish population sampling events in 1998 and 2006. Both found ¿multiple year classes¿ and a 2001 resources protection plan states that San Vicente Creek ¿supports a healthy steelhead run¿.

2. Section 3.8 of the Listing Policy goes on to say "Waters shall be placed on the section 303(d) list if evaluation of guidelines (satisfying the conditions of section 6.1.3) are exceeded using the binomial distribution in section 3.1." Section 6.1.3 identifies the criteria required for an evaluation guideline to be used. No evaluation guideline is cited for this line of evidence. Therefore, this line of evidence does not meet the requirements of the Listing Policy.

3. Section 6.1.4 of the Listing Policy states that¿¿numeric data are considered credible and relevant for listing purpose if the data set submitted meets the minimum quality assurance/quality control requirements¿¿. These include a QAPP or equivalent documentation. No quality assurance documentation is available for the Habitat Typing data summarized in the Line of Evidence and therefore it does not meet the requirements of the Listing Policy.

Finally, a 2010 habitat typing report for San Vicente Creek contradicts the findings summarized in LOE 1838 (which summarizes a habitat typing report from 1995). Specifically, 74 percent of the 123 pool tail-out areas evaluated were scored as ¿good¿ spawning conditions and the dominate substrate was recorded as gravel and small cobble. Note that 20 percent of the pool tail-out areas evaluated were scored ¿unsuited for spawning due to inappropriate substrate such as bedrock, log sills, boulders, or other considerations unrelated to embeddeness in fine sediment¿.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used do not satisfy the data quality requirements of section 6.1.4 of the Policy and therefore should not be used alone to make this decision.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. When the entire turbidity data set is evaluated, 158 of the 1483 samples exceed the water quality objective and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy.
4. When the dry weather months are eliminated from the turbidity data set is evaluated, 157 of the 1027 samples exceed the water quality objective and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy.
5. A more recent habitat typing assessment from this water segment indicates good spawning habitat and therefore the findings of the 1995 report are contradicted.
6. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the section 303(d) list because applicable water quality standards for the pollutant are not being exceeded.
 
State Board Staff Review of Regional Board Conclusion and Recommendation: Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the CWA section 303(d) List.

Data Used to Assess Water Quality: Flatwater habitat types comprised 76% of the total length of the survey, riffles comprised 8%, and pools comprised 15%. The pools are relatively shallow, with only 21 of the 70 (30%) pools having a maximum depth greater than 3 feet. Fifty-seven of the 70 pool tail-outs measured had embeddedness rating greater than 50% (CCRWQCB, 2004f).

The relatively large amount of cover is provided by primarily boulders in a habitat types. The mean percent canopy density for the stream was 87% which is considered adequate cover for juvenile coho salmon and steelhead. The percentage of right and left bank covered with vegetation was moderate at 73% and 76% respectively. Two gradients riffles measured had large cobble as the dominant substrate. Large cobble was also dominant in 4 of the 7 step runs measured.

Data Used to Assess Water Quality: The Davenport Sanitation District (DSD), which withdraws water from San Vicente Creek to serve the town of Davenport (adjacent to San Vicente Creek) has been unable to produce potable drinking water during periods of heavy rainfall due to high levels of turbidity. Turbidity levels at the influent were measured for 31 days in December 2001, 30 days in January 2002, and 30 days in December 2002 by the County of Santa Cruz Water and Wastewater Division at the Davenport Water influent. Twenty-two of 91 measurements were in exceedance of the criterion (Frediani, J. 2004).

- Mean shelter rating for pools was low with a rating of 12. A pool shelter rating of approximately 100 is desirable.

Spatial Representation: San Vicente Creek (304.11) was sampled. Biological sampling occurred at 7 sites and observations were made from the stream banks throughout the stream. The habitat was assessed throughout the stream with an inventory method that samples approximately 10% of the flatwater and riffle habitat.
Temporal Representation: The San Vicente Creek Stream Inventory Report was conducted by DFG on 7/9/1996 - 7/14/1996. Fish presence was observed on Oct. 16, 17, 21, 1995.
Environmental Conditions: The watershed is primarily privately owned and is managed for timber production, open pit mining, cattle grazing, urbanization and water diversion.
QAPP Information: The Habitat Inventory follows the methodology from the California Salmonid Stream Habitat Restoration Manual (Flosi and Reynolds, 1991 rev. 1994). The California Conservation Corps (CCC) Technical Advisors and Watershed Stewards Project/AmeriCorps (WSP/AmeriCorps) Members that conducted the inventory were trained in standardized habitat inventory methods by the California Department of Fish and Game (DFG). This inventory was conducted by a two-person team.

Fish were sampled by DFG using a Smith-Root Model 12 backpack electrofishing unit. Sampling techniques are discussed in the California Salmonid Stream Habitat Restoration Manual.

Data Used to Assess Water Quality: Water Board staff reviewed California Dept. of Fish and Wildlife Stream Habitat Assessment Report for San Vicemte Creek (surveyed in 2010) to evaluate impacts to beneficial uses. The following excerpts are taken from the report's conclusions. Note, each data type listed below is obtained by visual estimate.
Embeddeness: The depth of cobble embeddedness was estimated at pool tail-outs. Of the 123 pool tail-outs measured, 13 had a value of 1 (11%), 78 had a value of 2 (63%), 8 had a value of 3 (7%), 24 had a value of 5 (20%) (Graph 6). On this scale, a value of 1 indicates the best spawning conditions and a value of 4 the worst. Additionally, a value of 5 was assigned to tail-outs deemed unsuited for spawning due to inappropriate substrate such as bedrock, log sills, boulders, or other considerations unrelated to embeddeness in fine sediment.
Dominant substrate: Eighty of the 123 pool tail-outs measured had gravel and small cobble as the dominant substrate. This is generally considered good for spawning salmonids.

Data Used to Assess Water Quality: Site one yielded 37 steelhead ranging in total length from 62 millimeters to 187 millimeters and 1 coho salmon (81mm total length). Site two yielded 67 steelhead ranging in total length from 59 to192 mm, 2 sculpin (125mm and 137mm) and 1 coho (90 mm). Site three yielded 32 steelhead ranging in total length 53 - 188 mm and 4 sculpin ranging in length from 110 mm - 169 mm. Site four yielded 12 steelhead ranging in total length from 55 - 157mm and 1 sculpin (117mm). Site five yielded 25 steelhead ranging in total length from 60 - 206mm, 1 coho salmon (85mm) and 1 Pacific giant salamander. Site six yielded 30 steelhead ranging in total length from 54 mm - 269 mm. The fourth site was located at stream mile 1.95 and included a riffle, a run, and a mid-channel pool. The fifth site was located at stream mile 2.6 and included 2 mid-channel pools and a riffle. Site six was located at stream mile 2.93 and included a mid-channel, a riffle, and a plunge. Site seven was located at stream mile 3.3 and included 2 plunge pools and a step run.

QAPP Information: The Habitat Inventory follows the methodology from the California Salmonid Stream Habitat Restoration Manual (Flosi and Reynolds, 1991 rev. 1994). The California Conservation Corps (CCC) Technical Advisors and Watershed Stewards Project/AmeriCorps (WSP/AmeriCorps) Members that conducted the inventory were trained in standardized habitat inventory methods by the California Department of Fish and Game (DFG). This inventory was conducted by a two-person team.

Fish were sampled by DFG using a Smith-Root Model 12 backpack electrofishing unit. Sampling techniques are discussed in the California Salmonid Stream Habitat Restoration Manual.
