Regional Board Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4.9 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.

Two lines of evidence are available in the administrative record to assess this pollutant. The initial decision to place this water body segment-pollutant combination on the 303(d) list was made prior to 2006 and associated data and documentation are not held in an assessment database. As a result, there are no data associated with the LOE that is a placeholder for the original decision to add this water body segment-pollutant combination to the List. However, recent physical habitat and benthic invertebrate community data have been collected and are summarized in one LOE. None of the three samples have degraded biological community composition (EPT taxa richness less than 12) associated with more than 40 percent cover of deposited fine and sand sized sediment on the streambed. There are an insufficient number of samples to determine beneficial use support.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. None of the three samples have degraded biological community composition (EPT taxa richness less than 12) nor do they have more than 40 percent cover of deposited fine and sand sized sediment on the streambed and this sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

Data Used to Assess Water Quality: Water Board staff evaluated sediment grain size and EPT taxa data that was collected following the SWAMP physical habitat and benthic invertebrate protocol from Boulder Creek. At zero of the three stations, deposited fine and sand (FS) sediments on the stream bed were greater than 40%. In addition, none of the stations had less than 12 EPT taxa (EPT richness), the threshold for indicating degraded biological diversity and community composition at these locations.

This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.

Two lines of evidence (LOEs) are available in the administrative record to assess this pollutant. One LOE summarize unionized ammonia data in which zero of 14 samples exceed the Basin Plan general objective for unionized ammonia set to protect aquatic life. One LOE summarizes total ammonia data and zero of the 15 samples exceed the EPA's Lifetime Health advisory level for total ammonia in drinking water. This sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 16 samples is needed to determine if a beneficial use is supported and a minimum of two exceedances is needed to determine if beneficial uses are not supported using table 3.1. Therefore, the use support rating is set to 'insufficient information'.

This decision replaces the two previously approved decisions, one for each of the pollutants unionized ammonia (Decision 11189) and total ammonia (Decision 11190). This decision contains all of the LOEs from those decisions in addition to new LOEs.

The pollutant name was changed from ¿Unionized Ammonia¿ (Decision 11189) to ¿Ammonia¿ in the 2014 assessment cycle.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Zero of 14 samples exceed the Basin Plan general objective for unionized ammonia set to protect aquatic life and zero of the 15 samples exceed the EPA's Lifetime Health advisory level for total ammonia in drinking water. Neither of these exceed the allowable frequency listed in Table 3.1 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because applicable water quality standards are not being exceeded.

No new data were assessed for the 2014 listing cycle. This decision has not changed from the 2010 listing cycle.

This pollutant is being considered for placement on the section 303(d) list under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status.

Seven lines of evidence are available in the administrative record to assess this pollutant. Twelve of the 225 samples exceed the water quality objective for Cold Freshwater Habitat. The Basin Plan general water quality objective for oxygen saturation states that the median value shall not fall below 85% saturation. Furthermore, the oxygen saturation objective is only applied ¿for waters not mentioned by a specific beneficial use¿¿ and this waterbody is designated for Cold Freshwater Habitats. Therefore, the use support rating for oxygen saturation is set at Insufficient Information.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Twelve of the 225 samples exceed the water quality objective for Cold Freshwater Habitat and this does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy. In addition, the median value did not exceed the General Objective.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Note that the pollutant name for the older LOEs and decisions is electrical conductivity. This was an error and the pollutant name should have always been specific conductivity. The pollutant name has been changed to specific conductivity for the 2014 assessment.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This pollutant is being considered for placement on the section 303(d) list under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status.

Boulder Creek provides habitat for coho salmon and steelhead trout, which are listed as a threatened species under the federal Endangered Species Act.

Five lines of evidence are available in the administrative record to assess this pollutant. LOEs 18839, 11892, 11911 and 19897 summarize 128 grab samples and 2 overnight diurnal monitoring events. None of the 128 grab samples and neither of the overnight diurnal samples exceeded the evaluation guideline (optimum range for steelhead, Moyle, 1976) used to interpret the narrative water quality objective. LOE 53597 summarizes two years of continuous temperature measurements which are evaluated by calculating maximum weekly maximum temperature (MWMT). Both of the two MWMTs exceed the evaluation guideline (MWMT for Central Coast Coho, NOAA, 2012) used to interpret the narrative water quality objective. The MWMT sample size is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 26 samples is needed to determine if a beneficial use is supported using table 3.2. Therefore, the use support rating is set to 'insufficient information'.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:

3. Zero of the 128 grab samples and zero of the overnight diurnal samples exceed the optimal range for steelhead guideline. However, both of the MWMTs calculated from long term deployment of continuous temperature logger data exceeded the relevant evaluation guidelines used to interpret the narrative water quality objective. But these do not exceed the allowable frequency listed in Table 3.2 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Data Used to Assess Water Quality: Two out of two samples exceed the evaluation guideline for temperature in this water body. Water temperature data submitted by the Lompico Watershed Conservancy from the summer months of 2005 and 2006 showed that the maximum weekly maximum temperature (MWMT) exceeded 16 degrees Celsius. The MWMT is calculated for the year calander and therefore, for the purpose of this assessmen, a year of data is counted as a single sample and exceedance. These data were compiled by Donald Alley (fisheries biologist).

This is also consistent with the 'U.S. EPA Region 10 Guidance for Pacific Northwest State and Tribal Temperature Water Quality Standards' (USEPA 2003), in which the U.S. EPA recommends a criterion for the protection of moderate to high density summertime salmon and trout juvenile rearing (i.e., core juvenile rearing) of a maximum weekly maximum temperature (MWMT) of 16 degrees C. The MWMT is also known as the maximum 7-day average of daily maximums (7DADM). The 16 degrees C MWMT criterion is recommended to (1) safely protect juvenile salmon and trout from lethal temperatures; (2) provide upper optimal conditions for juvenile growth under limited food during the period of summer maximum temperatures and optimal temperatures for other times of the growth season; (3) avoid temperatures where juvenile salmon and trout are at a competitive disadvantage with other fish; (4) protect against temperature induced elevated disease rates; and (5) provide temperatures that studies show juvenile salmon and trout prefer and are found in high densities. Both the CDFG and NOAA strongly support the use of the USEPA temperature guidance for the purposes of water quality assessment in California. These criteria have been adopted by both Oregon and Washington state and used for 303(d) Listing and TMDL development by the North Coast Region Water Quality Control Board. Its use in other geographic settings is appropriate as it has been recognized that salmonid stocks do not tend to vary much in their life history thermal needs, regardless of their geographic location. There is not enough significant genetic variation among stocks or among species of salmonids to warrant geographically specific water temperature standards.
