Regional Board Conclusion:	This pollutant was removed from the CWA section 303(d) List in the 2012 assessment cycle after the mapped reach was revised and stations that have elevated nitrate concentrations are no longer included in this reach. Seventeen lines of evidence are available in the administrative record to assess this pollutant. Note that LOE 1911 summarized data for stations located in this reach and also located in the downstream reach. The stations in the downstream reach account for all of the exceedances of the water quality objective and therefore are not included in this assessment. The following is a summary of the data for this segment, ignoring data from the station that is located in the downstream segment. Zero of the 45 nitrate samples exceed the water quality objectives for the Agricultural Supply and Municipal and Domestic Supply beneficial uses. Zero of the 19 nitrate samples exceed the water quality objectives for Cold and Warm Freshwater Habitat beneficial uses. None of the 20 nitrate/nitrite samples exceeds the water quality objectives for Cold and Warm Freshwater Habitat. Zero of the 20 nitrate/nitrite samples exceed the water quality objectives for Municipal and Domestic Supply. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Zero of the 45 nitrate samples exceed the water quality objectives for the Agricultural Supply and Municipal and Domestic Supply beneficial uses. Zero of the 19 nitrate samples exceed the water quality objectives for Cold and Warm Freshwater Habitat beneficial uses. None of the 20 nitrate/nitrite samples exceeds the water quality objectives for Cold and Warm Freshwater Habitat. Zero of the 20 nitrate/nitrite samples exceed the water quality objectives for Municipal and Domestic Supply. These do not exceed the allowable frequency listed in Table 4.1 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the section 303(d) list because applicable water quality standards for the pollutant are not being exceeded in this reach of San Luis Obispo Creek. The listing was incorrectly assigned to this reach prior to 2006.

Regional Board Conclusion:	The pollutant name was changed to ¿Ammonia¿ in the 2014 assessment cycle. This decision replaces the two previously approved decisions, one for each of the pollutants unionized ammonia and total ammonia. This decision contains all of the LOEs from those decisions in addition to new LOEs. This pollutant is being considered for placement on the CWA section 303(d) List under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. Seven lines of evidence (LOEs) are available in the administrative record to assess this pollutant. Four LOEs summarize unionized ammonia data in which zero of the 35 samples exceed the water quality objective for unionized ammonia set to protect aquatic life. Three LOEs summarize total ammonia data and zero of the 45 samples exceed the EPA's Lifetime Health advisory level for total ammonia in drinking water. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Zero of the 35 samples exceed the water quality objective for unionized ammonia and zero of the 45 samples exceed the EPA's Lifetime Health advisory level for total ammonia in drinking water. These do not exceed the allowable frequency listed in Table 3.1 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because applicable water quality standards are not being exceeded.

Regional Board Conclusion:	This pollutant is being considered for placement on the CWA section 303(d) List under section 3.3 of the Listing Policy. Under section 3.3 a single line of evidence is necessary to assess listing status. The sample size for the evaluation guideline for water contact recreation for Escherichia coli (E. coli) is insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating. A minimum of 26 samples is needed to determine if a beneficial use is supported and a minimum of five exceedances is needed to determine if beneficial uses are not supported using Table 3.2. Therefore, the use support rating is set to 'insufficient information'. One line of evidence is available in the administrative record to assess this pollutant. Two of nine samples exceed the evaluation standard (Ambient Water Quality Criteria for Bacteria, USEPA, 1986) set to protect for water contact recreation (i.e. swimming, wading etc.). Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. Under section 3.2 a single line of evidence is necessary to assess listing status. Fourteen lines of evidence are available in the administrative record to assess this pollutant. Twenty-four of the 61 samples exceeded the water quality objectives for dissolved oxygen in Cold and Warm Freshwater Habitats, therefore these uses are not supported. However, all 24 exceedances occurred at "Fox Hollow" and there is no quality assurance plan for this monitoring data. In addition, the site description in the LOE for Fox Hollow states that the location is 'pool habitat'. If this dissolved oxygen condition is accurate for Fox Hollow then it appears to be a localized condition as the SWAMP program data collected less than a mile downstream (at Cuesta Park) has zero exceedances of the water quality objectives. The Basin Plan general water quality objective for oxygen saturation states that the median value shall not fall below 85% saturation. However, the oxygen saturation objective is only applied ¿for waters not mentioned by a specific beneficial use¿¿ and this water body is designated for both Cold and Warm Freshwater Habitats. Therefore, the use support rating for oxygen saturation is set at Insufficient Information. Staff do not recommend listing this water segment based solely on the data collected from Fox Hollow because of the lack of quality assurance information and the contrast with data collected nearby. Further data and information are needed regarding the environmental conditions at the Fox Hollow location before it can be determined if these data are representative of the creek and are accurate. Based on the readily available data and information, the weight of evidence indicates that there is insufficient justification for placing this water segment-pollutant combination on the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Zero of the 37 samples exceeded the water quality objectives and this does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy. 4. Although all 24 of the samples collected from Fox Hollow exceed the water quality objectives, the lack of quality assurance information and the contrast with data collected nearby indicate that these data may not meet the requirement of section 6.1.5 of the Listing Policy and therefore should not be the sole basis of a decision to add this water segment to the 303(d) List. 5. Data for this line of evidence for San Luis Obispo Creek (above Osos Street) was collected at 1 monitoring site [ Fox_Hollow - SLO Creek at Fox Hollow Road, also known as Station 1 (previously RW1), also known as Fox Hollow (400 meters upstream of US 101 overcrossing, just south of Fox Hollow Rd). The Fox Hollow site is accessible through City owned property approximately 100 meters south of Fox Hollow Rd. just behind the Police firing range. The creek cuts into the left bank just before a slide that has created a pool. Substrate is clay, sand, gravel, and rock. The canopy is composed mostly of oaks and sycamores. Seasonal grazing allow cattle access here winter and spring.

Under section 3.2 a single line of evidence is necessary to assess listing status. Four lines of evidence are available in the administrative record to assess this pollutant. Zero of the 47 samples exceed the evaluation guideline (Moyle, 1976) used to interpret the water quality objective for water temperature. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List. Samples were collected at Station 1 (previously RW1), also known as Fox Hollow(400 meters upstream of US 101 overcrossing, just south of Fox Hollow Rd). The Fox Hollow site is accessible through City owned property approximately 100 meters south of Fox Hollow Rd. just behind the Police firing range. The creek cuts into the left bank just before a slide that has created a pool. Substrate is clay, sand, gravel, and rock. The canopy is composed mostly of oaks and sycamores. Seasonal grazing allow cattle access here winter and spring.
