Regional Board Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under section 4.1 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.

Six lines of evidence are available in the administrative record to assess this pollutant in water samples. One sample can have multiple toxicity test results (or endpoints) but will be counted only once. One sample is defined as being collected on the same day at the same location.

Two samples are summarized in LOEs using each of the test organisms as the pollutant name (i.e. plant toxicity, invertebrate toxicity or vertebrate toxicity). Although the LOEs (#23701 and #23967) state that two of the two samples were toxic to the plant (algal) test organisms (meaning the sample water resulted in a significant decrease in cell density compared to the laboratory control), one of those samples should not have been counted as an exceedance because the specific conductivity of the sample was above the tolerance level of the test organism. The SWAMP Toxicity Work Group memo, dated July 8, 2013, states the following: For "Selenastrum capricornutum [the algal test organism] ¿ Include appropriate controls when sample conductivities exceed 1500 uS/cm. If conductivity exceeds 3000 uS/cm, use alternate species or forego testing." In the sample collected from station 312NIP on 2-26-2007, the specific conductivity measured over 1500 uS/cm but alternate controls were not used to calculate the statistical endpoint for the test. Therefore, this sample does not meet the quality control requirements of the SWAMP program or of the Listing Policy.

Only one of the two samples was toxic to the plant (algal) test organisms (exhibited a significant decrease in cell density compared to the laboratory control), and exceed the narrative General Objective for toxicity, set to protect for aquatic life beneficial uses.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of removing this water segment-pollutant combination from the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Some of the previous data used in the decision did not meet the quality control requirements of the SWAMP program. This water segment - pollutant combination should not have been added to the CWA 303(d) List in 2010.
4. One of the two samples (tested for toxicity to plants), exceed the narrative General Objective for toxicity but this does not exceed the allowable frequency listed in Table 3.1 or 4.1 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the section 303(d) list because applicable water quality standards for the pollutant are not being exceeded. The previous decision to add this segment to the List was based partly on faulty data.

Regional Board Conclusion: This pollutant is being considered for removal on the CWA section 303(d) List under sections 2.2, 4.2 and 4.3 of the Listing Policy. Under 4.3 of the Policy, a minimum of one line of evidence is needed to assess listing status.

Five lines of evidence are available in the administrative record to assess this pollutant. Forty of 57 samples exceed the evaluation guideline set to protect for water contact recreation (i.e. swimming, wading etc.) and 8 of 35 samples exceed the water quality objective for non-contact recreation.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. In accordance with section 2.2 of the Policy, there is sufficient justification to place it in the Being Addressed portion of the CWA 303(d) List because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Forty of 57 samples exceed the evaluation guideline set to protect for water contact recreation (i.e. swimming, wading etc.) and 8 of 35 samples exceed the water quality objective for non-contact recreation. Both of these exceed the allowable frequency listed in Table 4.2 of the Listing Policy.
4. The Santa Maria River Watershed Fecal Indicator Bacteria TMDL has been approved by USEPA on 04/24/2016.
5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Conclusion: This pollutant is being considered for removal on the CWA section 303(d) List under sections 2.2 and 4.1 of the Listing Policy. Under section 4.1 of the Policy, a minimum of one line of evidence is needed to assess listing status.

Sixteen lines of evidence are available in the administrative record to assess this pollutant. Nineteen of the 25 nitrate samples and 40 of the 50 nitrate/nitrite samples exceed the water quality objectives for the Municipal and Domestic Supply beneficial use. Twenty-three of the 25 nitrate samples 31 of the 33 nitrate/nitrite samples exceed the evaluation guideline (Central Coast Region Technical Report, 2010) for Cold and Warm Freshwater Habitat. In addition, the following evidence supports the conclusion that nitrate contributes to or causes a bio-stimulatory effect in this water segment.

1) Dissolved oxygen for this water body ranged from 5.31 to 15.58 mg/L, exceeding (falling below) the Cold Freshwater Habitat water quality objective of 7.0 mg/L, and the upper screening threshold of 13.0 mg/L (R3 NNE Technical Report, 2010).
2) Water column chlorophyll a concentration peaked at 22.5 ug/L, at times exceeding the screening threshold of 15 ug/L (R3 NNE Technical Report, 2010).
3) Using site-specific data from this waterbody, the California Benthic Biomass Predictor Tool, v. 13 (Tetratech, 2007) predicted a benthic algal contribution to oxygen deficit for this water body ranging from 1.86 to 4.18 mg/L. These exceed the screening threshold for benthic algal contribution to oxygen deficit of 1.25 mg/L (R3 NNE Technical Report, 2010).
4) Using site-specific data from this waterbody and the Revised Qual2K model, the California Benthic Biomass Predictor Tool, v. 13, QUAL2K model (Tetratech, 2007) predicted algae biomass ranging from 43 to 93 g/m2 AFDW. The upper prediction exceeds the Cold Freshwater Habitat screening threshold for algae biomass of 60 grams/m2 (Creager, et al., 2006).
5) Using site-specific data from this waterbody and the Revised Qual2K model, the California Benthic Biomass Predictor Tool, v. 13 (Tetratech, 2007) predicted benthic chlorophyll a concentrations ranging from 111 to 233 mg/m2. The upper prediction exceeds the Cold Freshwater Habitat screening threshold of 150 mg/m2 (Creager, et al., 2006).

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. In accordance with section 2.2 of the Policy, there is sufficient justification to place it in the Being Addressed portion of the CWA 303(d) List because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Nineteen of the 25 nitrate samples and 40 of the 50 nitrate/nitrite samples exceed the water quality objectives for the Municipal and Domestic Supply beneficial use. Twenty-three of the 25 nitrate samples 31 of the 33 nitrate/nitrite samples exceed the evaluation guideline (Central Coast Region Technical Report, 2010) for Cold and Warm Freshwater Habitat. These exceed the allowable frequency listed in Table 4.1 of the Listing Policy and there is evidence in support of the conclusion that nitrate contributes to or causes a bio-stimulatory effect in this water segment.

5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.
 
State Board Staff Review of Regional Board Conclusion and Recommendation: This conclusion is based on the staff findings that:

Regional Board Conclusion: The pollutant name was changed from ¿Unionized Ammonia¿ to ¿Ammonia¿ in the 2014 assessment cycle. This decision replaces the two previously approved decisions, one for each of the pollutants unionized ammonia and total ammonia. This decision contains all of the LOEs from those decisions in addition to new LOEs.

This pollutant is being considered for placement on the CWA section 303(d) List under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.

Six lines of evidence (LOEs) are available in the administrative record to assess this pollutant. Four LOEs summarize unionized ammonia data in which one of the 34 samples exceed the water quality objective for unionized ammonia set to protect aquatic life. Two LOEs summarize total ammonia data and zero of the 36 samples exceed the EPA's Lifetime Health advisory level for total ammonia in drinking water.


Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3.one of the 34 samples exceed the water quality objective for unionized ammonia set to protect aquatic life and zero of the 36 samples exceed the EPA's Lifetime Health advisory level for total ammonia in drinking water. These do not exceed the allowable frequency listed in Table 3.1 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because applicable water quality standards are not being exceeded.

Zero of the 36 samples exceed the evaluation guideline (North Carolina Administrative code, Title 15A) used to interpret the narrative water quality objective for bio-stimulation risk and aquatic life beneficial uses.

One of the one samples exceed the Evaluation Guideline (Siepmann and Finlayson, 2000, with minor corrections to significant figures as described in Beaulaurier et al., 2005) applied to protect for aquatic life beneficial uses. This decision will not use the single non-detect sample in the total count because the laboratory¿s method detection limit and reporting limits were greater than the evaluation guideline. Therefore the results could not be quantified with the level of certainty required by the Listing Policy.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status.

Twelve lines of evidence are available in the administrative record to assess this pollutant. Two water quality objectives are assessed. Five of the 42 samples exceeded the water quality objective for dissolved oxygen in Cold Freshwater Habitats and zero of the 42 samples also exceeded the water quality objective for dissolved oxygen in Warm Freshwater Habitats. The Basin Plan general water quality objective for oxygen saturation states that the median value shall not fall below 85% saturation. However, the oxygen saturation objective is only applied ¿for waters not mentioned by a specific beneficial use¿¿ and this water body is designated for both Cold and Warm Freshwater Habitats. Therefore, the use support rating for oxygen saturation is set at Insufficient Information.

Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status.

Six lines of evidence are available in the administrative record to assess this pollutant. Three of the 26 samples exceed the evaluation guideline for Cold Freshwater Habitat (Sigler et al. 1984) and three of the 26 samples exceed the Warm Freshwater Habitat evaluation guideline (Shoup, D.E. and Wahl D.H., 2009), both used to interpret the water quality objective for turbidity.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Three of the 26 samples exceed the evaluation guidelines and this does not exceed the allowable frequency listed in Table 3.2 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status.

Fifteen lines of evidence are available in the administrative record to assess this pollutant. Five beneficial uses are assessed. Zero of the 40 samples exceed the water quality objectives for Cold and Warm Freshwater Habitats, and one of the 40 samples exceed the water quality objectives for Drinking Water and Recreation.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Zero of the 40 samples exceed the water quality objectives for Cold and Warm Freshwater Habitats, and one of the 40 samples exceed the water quality objectives for Drinking Water and Recreation. These do not exceed the allowable frequency listed in Table 3.2 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because applicable water quality standards are not being exceeded.

Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status.

Three lines of evidence are available in the administrative record to assess this pollutant. Eight of the 42 samples exceed the evaluation guideline (Moyle, 1976) used to interpret the water quality objective for water temperature. This evaluation guideline is specific to steelhead trout and the PICES database (programmable information system for management and analysis of aquatic species range data in California) lists steelhead trout as a native species for Nipomo Creek.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Eight of the 42 samples exceed the evaluation guideline and this exceeds the allowable frequency listed in Table 3.2 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be placed on the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem.

Regional Board Conclusion: This pollutant is being considered for addition to the CWA section 303(d) List under sections 2.2, 3.2 and 3.3 of the Listing Policy. Under 3.3 of the Policy, a minimum of one line of evidence is needed to assess listing status.

One line of evidence is available in the administrative record to assess this pollutant. Six of 10 samples exceed the evaluation set to protect for water contact recreation (i.e. swimming, wading etc.).

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for adding this water segment-pollutant combination from the CWA section 303(d) List. In accordance with section 2.2 of the Policy, there is sufficient justification to place it in the Being Addressed portion of the CWA 303(d) List because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Six of 10 samples exceed the evaluation guideline set to protect for water contact recreation (i.e. swimming, wading etc.) and this exceeds the allowable frequency listed in Table 3.2 of the Listing Policy.
