Regional Board Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.
Four lines of evidence are available in the administrative record to assess this pollutant.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing the Porter Creek-Mark West Creek HUC-12 on the CWA section 303(d) List for Indicator Bacteria. This conclusion is based on the staff findings that:

1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. The impairment analysis utilized a 10% exceedance frequency for year-round and winter data analysis and a 4% exceedance frequency was utilized during the summer months. Thus, a minimum of 26 samples or 5 exceedances were required to calculate year-round or winter impairment and a minimum of 22 samples or 3 exceedances to calculate summer impairment.
4. The statewide objective for E.coli bacteria in freshwater (salinity equal to or less than 1 ppth 95% or more of the time during the calendar year) was used to assess impairment/pollution, applying the exceedance thresholds from the 303 (d) Listing Policy. If E.coli bacteria data exceeded the objective more than the allowable frequency in the Listing Policy, the HUC-12 was identified as impaired.
5. Water bodies were also identified as impaired using a weight of evidence approach if enterococci data from freshwater exceeded the USEPA Criteria more than the allowable frequency in the Listing Policy AND a public health advisory was posted at any recreational beach in the HUC-12 during 2013-2016.
6. One of 7 STV for E.coli calculated from year-round data in the Porter Creek-Mark West Creek HUC-12 exceed the objective. Additionally, 5 of 7 geometric mean and 3 of 7 STV for Enterococcus calculated from year-round data in the Porter Creek-Mark West Creek HUC-12 exceed the USEPA criteria. There were no public health advisories posted in this HUC-12. These data are insufficient to determine, with the power and confidence of the Listing Policy, the applicable beneficial use support rating.
7. Five of 10 geometric mean for E.coli calculated during the summer period in the Porter Creek-Mark West Creek HUC-12 exceed the objective and this exceeds the allowable frequency from the Listing Policy.
8. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the Porter Creek-Mark West Creek HUC-12 should be placed on the section 303(d) list for Indicator Bacteria because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem.

LOE 47197 is a copy of placeholder LOE 4770 from the 2006 Listing cycle. LOE 47426 is new for the current Integrated Report cycle.
