Regional Board Conclusion: The "Eureka Plain HU, Elk River" water body has been split into three water bodies for the current Integrated Report cycle: (1) Eureka Plain HU, Elk River Watershed, Lower Elk River and Martin Slough, (2) Eureka Plain HU, Elk River Watershed, Upper Elk River, and (3) Eureka Plain HU, Elk River Watershed, Upper Little South Fork Elk River.

LOEs 47453, 47450,47488, and 47489 are new for the current Integrated Report cycle.

Fecal indicator bacteria (which includes E. coli and fecal coliform) are being considered for placement on the Section 303(d) list under Section 3.2 and 3.3 of the Listing Policy. Under these sections a single line of evidence (LOE) is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess fecal indicator bacteria in the lower mainstem Elk River and two lines of evidence are available to assess fecal indicator bacteria in Martin Slough.

In accordance with Section 3.3 of the Listing Policy, a 4% exceedance rate shall be used to add waters to the List "if water quality monitoring was conducted April 1 through October 31 only". The E. coli data collected in Martin Slough (LOE 47489), the fecal coliform data collected in the lower Elk River (LOE 47450), and the E. coli data collected in the lower Elk River (LOE 47488) were collected during this timeframe only. One of one fecal coliform sample from the lower Elk River violates the evaluation guideline, however this sample size is insufficient to determine with the power and confidence of the listing policy if standards are being met as there must be either (1) at least 22 samples available for evaluation in order to make a listing determination or (2) 3 or more exceedances from less than 22 samples in which case listing can occur. Six of 8 E. coli samples from Martin Slough and 5 of 6 E. coli samples from the lower Elk River exceed the evaluation guideline and this violates the allowed 4% exceedance frequency.

The fecal coliform data assessed in LOE 47453 for Martin Slough includes data collected during months outside the April - October range. Therefore, the data are being considered under section 3.2 of the Listing Policy, using a 10% exceedance rate. Four of 6 fecal coliform samples from Martin Slough exceed the evaluation guideline, and this sample size is insufficient to determine with the power and confidence of the listing policy if standards are being met as there must be either (1) at least 26 samples available for evaluation in order to make a listing determination under section 3.2 or (2) 5 or more exceedances from less than 26 samples in which case listing can occur.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing the lower mainstem Elk River and Martin Slough on the Section 303(d) list for Indicator Bacteria (i.e., sufficient justification to list). This conclusion is based on the staff findings that: (1) The data used satisfy the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfy the data quantity requirements of Section 6.1.5 of the Policy. (3) 6 of 8 E. coli samples from the Martin Slough and 5 of 6 E. coli samples from the lower mainstem Elk River exceeded the evaluation guideline and this exceeds the allowable 4% exceedance frequency from the Listing Policy. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
