Regional Board Conclusion: | This pollutant was considered for placement on the section 303(d) list under sections 3.1 and 3.5 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status. Three lines of evidence are available in the administrative record to assess this pollutant.
Three LOEs were not used in the final listing decision due to the criterion change. The data in these LOEs were reassessed in new LOEs with the new criterion and these replacement LOEs are used in the final listing decision. These LOE replacements are as follows: 1) LOE 22590 was replaced with LOE 95431; 2) LOE 22599 was replaced with LOE 95465; and 3) LOE 22591 was replaced with LOE 95466 Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2.
