Regional Board Conclusion: This pollutant is being considered for removal from the section 303(d) list under sections 4 of the Listing Policy. Under section 4.1, a single line of evidence is necessary to assess listing status.

One line of evidence is available in the administrative record to assess this pollutant. Two of 11 water samples exceed the water quality objective.

The original LOE (2689) indicated that there were 3 exceedances in the eleven samples that also exceeded the primary MCL. LOE 2689 was a placeholder, i.e., no data reference was provided because the original decision was made in 2006. Since it is impossible for there to be more exceedances of the primary MCL (1,000 ug/L) than of the secondary MCL (200 ug/L), the text describing the exceedances of the primary MCL was removed from this decision.

This was likely a typo with 2 exceedances of the primary and 3 exceedances of the secondary MCLs.

However, the objective is for a secondary MCL for drinking water, and the concentration of total metals will be reduced when the water is treated prior to delivery to consumers. Region 5 is in the process of amending their Basin Plan to establish the appropriate method for assessing secondary MCLs in the region including using only dissolved metals data.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Two of 11 water sample results exceeded the water quality objective and this exceeds the allowable frequency listed in Table 4.1 of the Listing Policy. But the weight of evidence supports a delisting based on regional specific weight of evidence.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.
 
Regional Board Decision Recommendation: No new data were assessed by the Regional Board for the 2014 Integrated Report. The decision has been changed from 'List' to 'Delist' based on a new comparison of the original sample and exceedance counts with the listing criteria for conventional pollutants (including aluminum). Based on this re-assessment, this water body and pollutant are proposed for removal from the 303(d) List.

Spatial Representation: El Dorado Hills Wastewater Treatment Plant (EDHWWTP) is approximately 30 miles east of Sacramento in Section 14, T9N, R8E, MDB&M. Samples were collected at the effluent discharge Parshall flume, which is located immediately prior to the Carson Creek discharge point except during June through October 2001 when samples were collected from the chlorine contact tank.
Temporal Representation: Samples were collected from March 2001 through February 2002.
Environmental Conditions: From June through October 2001, the EDHWWTP was conducting reclaim operations, rather than discharging treated effluent to Carson Creek.
