Regional Board Conclusion: The weight of evidence (see below) indicates that the original 1998 listing was for impairment of the MUN Beneficial Use and the bacteria-based water quality objectives for MUN were removed with the Santa Ana Regional Water Board REC Standards Basin Plan Amendment. Further, the most recent data, which on its own could not be used in this 2016 Integrated Report to justify a delisting action, simply provides further evidence that Lake Fulmor is attaining the REC-1 Beneficial Use.

Evidence used for Decision -

Lake Fulmor was added to the 303(d) List in 1998 based on a finding that the waterbody was impaired for ¿pathogens.¿ Subsequent listing cycles in 2002 and 2006 retained the listing. None of these three 303(d) lists indicated what beneficial use was impaired, only that the impairment was for ¿pathogens.¿ The 2010 303(d) List was the first list that included a Fact Sheet for Lake Fulmor (Decision #7225). This appears to be the first time that the impaired beneficial use was identified, i.e., Water Contact Recreation (REC‐1).

No Administrative Record appears to be available for the 1998 listing, but an Administrative Record has been established to support the 2002 and 2006 303(d) Listings. The publicly available Administrative Record includes one water quality report for Lake Fulmor (Reference #225): Santa Ana RWQCB. 1992. Water quality data‐Fulmer [sic] Lake. Riverside, CA: Santa Ana RWQCB. This report documents water quality results from a single day sampling event at three lake sites on August 19, 1992. The report concludes that the MUN total coliform objective was not being met, but makes no mention regarding compliance with the REC‐1 fecal coliform water quality objectives. At the time of the 1998 303(d) listing the MUN total coliform objective was 100 MPN/100 mL and the data clearly shows 3 of 3 exceedances of the MUN water quality objective. In fact, the report in the Administrative Record states: ¿Due to the high levels of coliform present in the lake the beneficial use of MUN is definitely not being met¿ (see Administrative Record reference #225).
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the section 303(d) list because applicable water quality standards for the pollutant are not being exceeded.
