This pollutant is being considered for removal from the section 303(d) list under section 4.1 of the Listing Policy. Under section 4.1 a single line of evidence is necessary to assess listing status. Three lines of evidence are available in the administrative record to assess this pollutant.

Based on the readily available data and information, the weight of evidence indicates that there is insufficient justification in for removing this water segment-pollutant combination from the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Two of 3 water samples collected from China Slough in 2004 exhibited a statistically significant difference in Selenastum capricornutum (an algal plant species) growth (total cell counts) compared to control, and this exceeds the narrative toxicity objective and the allowable frequency listed in Table 3.1 of the Listing Policy.
4. Zero of 3 water samples collected from China Slough in 2004 exhibited a statistically significant difference in Ceriodaphnia dubia (an invertebrate species) survival compared to control, and this does not exceed the narrative toxicity objective or the allowable frequency listed in Table 3.1 of the Listing Policy.
5. Zero of 3 water samples collected from China Slough in 2004 exhibited a statistically significant difference in Pimephales promelas (Fathead Minnow, a vertebrate species) survival compared to control, and this does not exceed the narrative toxicity objective or the allowable frequency listed in Table 3.1 of the Listing Policy.
6. Pursuant to section 3.11 of the Listing Policy, no additional data and information were available during the 2014 Integrated Report cycle indicating that standards are being met.

Data Used to Assess Water Quality: Two of three water samples collected under the Irrigated Lands Reporting Program from China Slough in 2004 exhibited a statistically significant difference in Selenastrum capricornutum (an algal plant species) growth (total cell counts) compared to control (both toxic water samples had total cell counts that were 70% percent of control and violated the narrative toxicity objective). The two toxic water samples were collected 12 August 2004 and 16 September 2004.

Evaluation Guideline: Statistically significant difference from control sediment using Dunnett's test in 10-day Hyalella azteca sediment toxicity tests. Arcsin squareroot transformation was used when necessary to meet the assumptions of normality and homogeneity of variance. Steel's Many-One Rank Test was used for comparison to control if these assumptions were not met after transformation.
