Regional Board Conclusion: Fecal indicator bacteria (which includes enterococcus, fecal coliform and total coliform) are being considered for placement on the Section 303(d) list under Section 3.3 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. Five LOEs are available in the administrative record to assess indicator bacteria for water contact recreation (REC-1): two for enterococcus and three for fecal coliform. Additionally, one LOE is available for the assessment of total coliform as it applies to the shellfish harvesting beneficial use (SHELL).

Data from LOEs 25263 and 32674 were re-evaluated with LOEs 133685 and 133608. Data from LOEs 25263 and 44732 were re-evaluated with LOEs 133621 and 133692. Data from LOEs 47635 and 47636 were re-evaluated with LOE 133628. LOEs 133608 and 133621 were not used in this assessment as they were evaluated at a 10% exceedance rate and contain the same data as LOEs 133682 and 133724, which were evaluated at a 4% exceedance rate.

In the 2010 Integrated Report, the data results for single sample maximum and geometric mean calculations were presented in the same LOE. In the 2012 Integrated Report, the data results for single sample maximums and geometric mean calculations are presented in two separate LOEs. The following summary presents the total number of exceedances and total sample count from the listing cycles combined, for single sample maximum separate from geometric mean: 1) 1 of 107 samples exceed the Statistical Threshold Value (STV) objective for enterococcus; 2) 0 of 354 samples exceed the geometric mean objective for enterococcus; 3) 1 of 186 samples exceed the singles sample maximum objective for fecal coliform; 4) 0 of 113 samples exceed the geometric mean objective for fecal coliform. For assessing SHELL beneficial use, 1 of 466 samples exceed the median concentration objective for total coliform.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against adding this water segment-pollutant combination to the Section 303(d) list (i.e., sufficient justification to not list). This conclusion is based on the staff findings that: (1) The data used satisfy the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfy the data quantity requirements of Section 6.1.5 of the Policy. (3) Enterococcus and fecal coliform samples do not exceed the objectives more than the allowable frequency identified in Table 3.2 of the Listing Policy. (4) Total coliform samples related to the SHELL beneficial use do not exceed the median concentration objective more than the allowable frequency identified in section 4.3 of the Listing Policy. (5) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because applicable water quality standards are not being exceeded.
