Regional Board Conclusion: Fecal indicator bacteria (which includes enterococcus, fecal coliform, and total colifrom) are being considered for placement on the Section 303(d) list under Section 3.3 of the Listing Policy. Under this section a single line of evidence (LOE) is necessary to assess listing status. Six LOEs are available in the administrative record to assess indicator bacteria in this water body for the protection of contact recreation (REC-1): two for enterococcus and three for fecal coliform. Additionally, one LOE is available for the assessment of total coliform as it applies to the shellfish harvesting beneficial use (SHELL).

Data from LOE 32733 were re-evaluated with LOEs 133594 and 133694. Data from LOEs 44730 and 133598 were re-evaluated with LOEs 133636 and 133679. Data from LOE 25297 were re-evaluated with LOEs 133594, 133694, 133636, and 133679. Data from LOEs 47630 and 47629 were re-evaluated with LOE 133668.

The data assessed in this decision are ocean beach bacteria data collected in accordance with AB411 (Chapter 765, Statutes of 1997) requirements. In accordance with Section 3.3 of the Listing Policy, a 4% exceedance rate shall be used to add waters to the List "if water quality monitoring was conducted April 1 through October 31 only". However, the data assessed in this decision include data collected during months outside the April - October range. Therefore, this pollutant is being considered for addition to the section 303(d) list under section 3.3 of the Listing Policy at a 10% exceedance rate. LOEs 133694 and 133679 were not used in this assessment as they were assessed at a 4% exceedance rate.

The following summary presents the total number of exceedances and total sample count: 1) 2 of 117 samples exceed the Statistical Threshold Value (STV) objective for enterococcus for REC-1; 2) 0 of 385 samples exceed the geometric mean objective for enterococcus for REC-1; 3) 0 of 187 samples exceed the singles sample maximum objective for fecal coliform for REC-1; 4) 0 of 116 samples exceed the geometric mean objective for fecal coliform. For assessing SHELL beneficial use, 12 of 381 samples exceed the median concentration objective for total coliform.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against adding this water segment-pollutant combination to the CWA Section 303(d) list. This conclusion is based on the staff findings that: (1) The data used satisfy the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfy the data quantity requirements of Section 6.1.5 of the Policy. (3) Enterococcus, fecal coliform, and total coliform samples do not exceed the objectives more than the allowable frequency listed in Table 3.2 of the Listing Policy. (4) Pursuant to Section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. All beneficial uses are fully supported for this water body.
 
Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be placed on the section 303(d) list because applicable water quality standards are not being exceeded.
