Regional Board Conclusion:	The San Lorenzo River Watershed Pathogen TMDL (specifically including Carbonera Creek) was approved by the Central Coast Regional Board March 21, 2008. This TMDL is awaiting State Board and USEPA approval. Because this water segment / pollutant combination is included in the TMDL, this pollutant is being considered for removal from the section 303(d) list under section 4.3 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. Seven lines of evidence are available in the administrative record to assess this pollutant. One LOE (#3934) is a placeholder for the original listing. In addition, 2 LOEs summarize E. coli data collected in Carbonera Creek. Two of the 7 samples exceed the Water Contact Recreation water quality objective and none of the 7 samples exceed the Non-Contact Recreation water quality objective. Based on the readily available data and information, the weight of evidence indicates that there is insufficient justification for removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Two of 7 samples exceeded Water Contact Recreation Objective and this is an insufficient number of samples to consider delisting; a minimum of 28 samples are required. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

Regional Board Conclusion:	This pollutant is being considered for removal from the section 303(d) list under section 4.1 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. A TMDL was approved by USEPA on January 14, 2003. The RWQCB is tracking the implementation of the TMDL through the Nitrate Management Plan being implemented by Santa Cruz County. Eight lines of evidence (LOEs) are available in the administrative record to assess this pollutant. One LOE (LOE #1845) is a placeholder that does not contain data or information. Staff is unable to reconstruct the original data used to place this water segment-pollutant combination on the section 303(d) list. Three LOEs contain all data evaluated for this assessment and compares that data to the Municipal and Domestic Supply Objective. None of the 86 samples exceed this objective. Three additional LOEs assessed this same data, compared to the Agricultural Supply water quality objective. None of the 86 samples exceed this objective. One LOE summarized nitrate data compared to the numeric target established by the TMDL (Resolution #00-003, adopting the TMDL for nitrate in the San Lorenzo River Watershed) to protect for the Municipal and Domestic Supply beneficial use. The numeric target meets the criteria of the Listing Policy (Section 6.1.3) as it is applicable to the beneficial use, protective of the beneficial use, linked to the pollutant under consideration, scientifically based and peer reviewed, well described and identified a range above which negative impacts will occur. Fifty-four of 72 samples exceed the Evaluation Guideline (the numeric target from the TMDL, 2000). Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Fifty-four of 72 samples exceed the Evaluation Guideline (the numeric target from the TMDL, 2000) and this exceeds the allowable frequency calculated from the equation in Table 4.1 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Under section 3.1 a single line of evidence is necessary to assess listing status. Four lines of evidence are available in the administrative record to assess this pollutant. One of the 114 samples exceeds the water quality objective for Agricultural Supply. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. Interpretation of adverse effect shall be as derived from the University of California Agricultural Extension Service guidelines provided in Table 3-3 (Central Coast Waterboard Basin Plan, Chapter III, Section II.A.2 Objectives for all Inland and Surface Waters, Enclosed Bays and Estuaries). Regional Board Conclusion:	This pollutant is being considered for listing under section 2.2 of the Listing Policy. Under this section of the Policy, a minimum of one line of evidence is needed to assess listing status. The San Lorenzo Sediment TMDL was approved by the RWQCB in May of 2003 and subsequently approved by USEPA on February 19, 2004. Based on the readily available information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list.

Regional Board Decision Recommendation:	No new data were assessed for 2008. The decision has not changed.
