Regional Board Conclusion: Regional Board Conclusion:
This pollutant is being considered for removal from the section 303(d) list under section 4.3 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.

Three lines of evidence are available in the administrative record to assess Enterococcus consistent with Listing Policy, Section 4.3. The pollutant name used for the listing is Indicator Bacteria, however the assessment is based on Enterococcus data.

One line of evidence (LOE # 3504) summarizes data collected by Santa Barbara County Health Department between June 1999 and October 2005. This data was the basis for adding Goleta Beach to the Section 303(d) list for Indicator Bacteria and the justification for this follows: 39 out of 358 exceedances of the single sample maximum for Enterococcus and 72 out of 339 exceedances of the geomean for Enterococcus. In this assessment the number of geomean exceedances does exceed the allowable frequency in Table 4.2. However, this assessment is based on calculation of a rolling daily geomean which results in biasing the assessment to a high number of exceedances.

Two additional lines of evidence summarize weekly data collected from January 2004 to December 2006. This overlaps with the data used in EPA's assessment, through October 2005 and contains an additional 14 months of data. Assessment of these data demonstrates that applicable water quality standards for Enterococcus are not being exceeded in this water segment. This assessment differs from EPA's in that a non-overlapping 30-day geomean was calculated for every month that had 2 or more samples. Fourteen of 153 samples exceed the single sample Objective for Water Contact Recreation and four of 32 geomean values exceed the geomean Objective for Water Contact Recreation.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the section 303(d) list.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Fourteen of 153 samples exceed the single sample Objective for Water Contact Recreation and four of 32 geomean values exceed the geomean Objective for Water Contact Recreation. Neither of these exceeds the allowable frequency listed in Table 4.2 of the Listing Policy.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.


State Board Review and Conclusion:

Based on comments received from U.S. EPA (comment letter # 60), on the April 19, 2010 State Water Board staff report for the 2010 Integrated Report, State Water Board staff added 2 LOE's (31444 and 31445) asessing the AB411 (dry weather) data for this waterbody. Staff reviewed the bacteria data for this water body in the Central Coast Region described in the comment letter. Staff recommendation has not changed for this water body - pollutant combination based on evaluation of the dry weather data that was not included in the original Central Coast Region assessment.

On August 4, 2010 the State Water Board approved the staff listing recommendation to remove this water body from the 303(d) list for enterococcus.
The final language for the recommendation is:

This pollutant is being considered for removal from the section 303(d) list under section 4.3 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status.

There are two additional lines of evidence for dry weather single sample and geometric mean calculations. Three of 92 samples exceeded the recreational use single sample criteria and zero of 19 geo-metric mean calculations exceeded the geo-metric mean criteria.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the section 303(d) list.

Four lines of evidence are available in the administrative record to assess this pollutant. When compared to the Ocean Plan Objectives for Water Contact Recreation, two of 151 samples exceeded the single sample maximum Objective, three of 32 geomean assessments exceeded the geomean Objective and eight of 153 ratios exceed the total-fecal coliform ratio Objective. However, when compared to Ocean Plan Objectives for Shellfish Harvesting, 58 of 153 samples exceeded the Objective.

4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
