Two lines of evidence are available in the administrative record to assess this pollutant. Based on section 3.1 the site exceeded numeric objectives for toxic pollutants. Using the binomial distribution, waters shall be placed on the section 303(d) list if the number of measured exceedances supports rejection of the null hypothesis as presented in Table 3.1. Nine of 24 samples exceed the General water quality objective as it applies to the Cold Freshwater Habitat beneficial use.

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under sections 2.1 and 3.1 of the Listing Policy.

Four lines of evidence are available in the administrative record to assess this pollutant. Based on section 3.1 the site exceeded numeric objectives for toxic pollutants. Using the binomial distribution, waters shall be placed on the section 303(d) list if the number of measured exceedances supports rejection of the null hypothesis as presented in Table 3.1.

Five of 5 nitrate samples exceeded the water quality objective for Municipal and Domestic Supply and 19 of 19 nitrate + nitrite samples exceed the OEHHA Public Health Goal in Drinking Water (December 1997) as it applies to the Municipal and Domestic Supply beneficial use. Both of these Line of Evidence support rejection of the null hypothesis.

A recent publication (Steelhead/Rainbow Trout (Oncorhynchus mykiss) Resources South of the Golden Gate, California (Becker, G.S and I.J Reining, October 2008) identifies Santa Maria River as having "Definite run or population" and as being a viable migration corridor to the upper watershed of the Sisquoc River, where steelhead are still observed regularly. Therefore, discharge of warm water from Green Valley Creek is specifically prohibited by the General Objectives in the Central Coast Water Quality Control Plan which states that natural receiving water temperature of intrastate waters shall not be altered unless it can be demonstrated to the satisfaction of the Regional Board that such alteration in temperature does not adversely affect beneficial uses.

Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under section 3.1 and section 3.6 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.

Ten lines of evidence are available in the administrative record to assess this pollutant in water samples. Five of the samples were toxic to test organisms (exhibited a significant increase in mortality or decrease in cell density compared to the laboratory control) and therefore exceed the narrative General Objective for toxicity, set to protect for aquatic life beneficial uses.

The following is a summary of the results from individual toxicity tests. None of 6 samples (tested for toxicity to plants), exceed the narrative General Objective for toxicity. In addition, None of the 5 samples (tested for toxicity to vertebrate test organisms), exceed the narrative General Objective for toxicity. However, 5 of 6 samples (tested for toxicity to invertebrate test organisms), exceed the narrative General Objective for toxicity and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Five of the 6 samples (tested for toxicity to invertebrate test organisms), exceed the narrative General Objective for toxicity and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
