Regional Board Conclusion: This pollutant is being considered for placement on the section 303(d) list under sections 2.1 and 3.2 of the Listing Policy.

Four lines of evidence are available in the administrative record to assess these pollutants. Two water quality objectives are assessed: Eight of the 25 samples exceed the dissolved oxygen water quality objective for Cold Freshwater Habitat and 17 of 25 samples exceed the general water quality objective for oxygen saturation (when applied as a single sample maximum). This also exceeds the Basin Plan objective for oxygen saturation which states that the median oxygen saturation value shall not fall below 85%.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Eight of the 25 samples exceed the dissolved oxygen water quality objective for Cold Freshwater Habitat and this exceeds the allowable frequency listed in Table 3.2 of the Listing Policy. In addition, 17 of 25 samples exceed the general water quality objective for oxygen saturation (when applied as a single sample maximum). This also exceeds the Basin Plan objective for oxygen saturation which states that the median oxygen saturation value shall not fall below 85%.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Eight of 10 samples exceeded the water quality objective for Municipal and Domestic Supply and 10 of 14 samples exceeded the OEHHA public Health Goal in Drinking Water (December 1997) as it applies to the Municipal and Domestic Supply beneficial use. Each of these exceeds the allowable frequency listed in Table 3.1 of the Listing Policy and therefore support rejection of the null hypothesis.

This Evaluation Guideline is relevant for Merrit Ditch as it is a tributary to Old Salinas River and Tembladero Slough, both known be a migration corridor for Steelhead populations (Steelhead/Rainbow Trout Resources south of the Golden Gate, California - Becker and Reining, October 2008). Steelhead have been recently documented in both Gabilan and Natividad Creeks, both tributaries to Tembladero and located upstream of Merrit Ditch.

This conclusion is based on the staff findings that:
