Regional Board Staff Conclusion: Regional Board conclusion: This pollutant was considered for placement on the section 303(d) list in a previous assessment cycle. No new information was reviewed for this current assessment cycle. Therefore, the previous conclusion remains unchanged, and is as follows:

This pollutant is being considered for placement on the section 303(d) list under section 3.1 of the Listing Policy. Under section 3.1 a single line of evidence is necessary to assess listing status.

One line of evidence is available in the administrative record to assess this pollutant. A sufficient number of samples exceed the water quality objective.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Seven of 38 samples exceeded the ammonia water quality objective and this exceeds the allowable frequency listed in Table 3.1 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

None of the samples exceeded the one-hour criteria. Every sample collected during the summer months exceed the 4-day criteria, for total of seven exceedances. These data characterize the summer season as the critical condition.

Regional Board Staff Conclusion: This pollutant is being considered for placement on the section 303(d) list under sections 3.1, 3.5 and 3.11 of the Listing Policy. Under sections 3.1 & 3.5, a single line of evidence is necessary to assess listing status.

Five lines of evidence, two which assess fish tissue data for the COMM beneficial use and three which assess fish tissue data for the WILD beneficial use, are available in the administrative record to assess this pollutant.

For the COMM beneficial use assessments: LOE 133338 contains trophic level 3 fish tissue data but the composite tissue samples in this LOE consist of only two fish. 1 of 1 sample in LOE 133338 exceed the applicable water quality objective but there is insufficient information to determine impairment from this data set as the tissue composites are made from less than 8 individual fish. 0 of 1 samples in LOE 132843 exceed the applicable water quality objective, but there is only one composite sample consisting of 10 individual fish. To make a final use rating of fully supporting there must be three or more composite samples in this LOE. LOE 132843 also replaces LOEs 45797 & 47522 which were written for the 2012 listing cycle using a now superseded water quality objective (45797 and 47522 superseded LOE 31063 from the 2010 cycle). Considering all available evidence, staff recommend a final use support rating of 'Not Supporting' for the COMM beneficial use because of the mercury concentrations recorded in Rainbow Trout collected in 2012 by SWAMP staff.

For the WILD beneficial use assessments: LOEs 132834 & 132862 assess trophic level 3 fish which were collected in accordance with the fish length requirements of the water quality objective. 1 of 2 samples from these LOEs exceed the applicable water quality objective for the protection of WILD. The exceeding composite sample is contained in LOE 132834 and it is aggregated from eight individual rainbow trout. Accordingly, the final use support rating for this LOE is determined as not supporting. LOE 132862 contains trophic level 3 fish tissue data aggregated from ten individual fish and 0 of 1 samples exceed the applicable objective. The use support rating for this LOE is insufficient information as there are less than three composite samples contained in this LOE. LOE 133170 contains a length based assessment for prey fish, and 0 of 1 of the composite samples exceeds the water quality objective. As this data set comprises of ten individual fish but not three composite samples, the final use support rating is determined as insufficient information.

Additional Information: In 2015 USGS published a report titled 'Estimating Exposure of Piscivorous Birds and Sport Fish to Mercury in California Lakes Using Prey Fish Monitoring¿A Predictive Tool for Managers' which cited several lakes in the Lahontan Region as likely adversely impacting mercury concentrations in populations of grebes living in their vicinity. Crowley Lake was one of those lakes. The Regional Board has included the conclusions from the USGS report by reference as a secondary line of evidence which supports the decision to list the waterbody for mercury impairment. The reference for this supporting data is ref4604 and can be found in the CalWQA database.

The Regional Board listing decision for this waterbody is LIST, based first on the information contained in LOEs 132834 which indicates that trophic level three fish are impaired for mercury from a composite fish tissue sample containing eight individual fish, and second because of the likely impacts to grebe populations at Crowley Lake identified by the referenced USGS report. Ancillary evidence which supports the decision the list are the exceedances reported in LOE 133338 (which do not meet the requirement that composite samples contain 8 or more individual fish - the final use support rating for this LOE is therefore 'insufficient information' for the 2018 assessment) and the conclusions of the 2015 USGS mercury contamination in lakes study.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfy the data quantity requirements of section 6.1.5 of the Policy.
3. 1 of 1 composite tissue samples comprising of 8 or more individual fish exceeded the water quality objectives for the WILD beneficial use (LOE 132834).
4. Data contained in LOE 133338 show exceedances of the applicable water quality objectives, but there is insufficient tissue data (less than 8 individuals per composite) in these LOEs to adequately determine if there is a mercury impairment in the waterbody at this time. Regional Board staff recommend placing this waterbody on the list of impaired waters as a precaution for the protection of human health pending further investigation.
5. A 2015 USGS report that states that local populations of grebes are very likely impacted by mercury contamination of fish from Crowley Reservoir.
 
Regional Board Staff Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be placed on the section 303(d) list because the applicable water quality standards appear to be being exceeded. Targeted fish tissue sampling should be undertaken in the waterbody to further delineate mercury issues.

Evaluation Guideline: The USEPA 304(a) recommended water quality criterion for concentrations of methylmercury in fish tissue of trophic level 4 fish (150 - 500 mm; fillet wet weight) is 0.2 mg/kg. Total mercury is usually analyzed for most fish studies and assumed to be 100 percent methylmercury for the purposes of risk assessment (Klasing & Brodberg 2008). The fish consumption rate of 32 g/day is considered more protective of human health since recommendations are now to eat one meal per week of fish to obtain necessary Omega-3 nutrition. The fish consumption rate of 32 g/day is also protective of wildlife, as it protects 6 out of 7 endangered species.

Seasonal occurrences of algae blooms will likely persist in the lake, but they are natural conditions of the lake due to its environmental setting. Evaluation Guideline: The modified OEHHA Fish Contaminant Goal for endosulfan (l and ll) in fish tissue is 13,000 ppb. This screening level assumes an average body weight of 70 kg and a consumption rate of 32 g/day. A cooking reduction factor of 1 is applied for skin-off fillets.
