Regional Board Staff Conclusion: This pollutant is being considered for removal from the CWA section 303(d) List under sections 4.1 & 4.5 of the Listing Policy. Under these sections a single line of evidence is necessary to assess listing status.

Three lines of evidence, two which evaluate fish tissue data for the COMM beneficial use and one which evaluates fish tissue data for the WILD beneficial use, are available in the administrative record to assess pollutant. 1 of 1 composite trophic level four fish tissue samples aggregated from three individual fish exceed the applicable objective for the COMM beneficial use. 5 of 5 small mouth bass tissue samples assessed during the 2012 cycle exceeded the applicable water quality objective. 1 of 1 composite 50-150mm length prey fish samples aggregated from thirteen individual fish exceeded the applicable objective for the WILD beneficial use.

LOE 133123 replaces the 2012 LOEs 45811 and 47536 which were written using a now superseded mercury objective. LOE 133123 uses the same data but assess the information against the new mercury objectives. The 2012 LOEs will be removed from the next iteration of this decision during the next assessment cycle.

In 2015 USGS published a report titled 'Estimating Exposure of Piscivorous Birds and Sport Fish to Mercury in California Lakes Using Prey Fish Monitoring¿A Predictive Tool for Managers' which cited several lakes in the Lahontan Region as likely adversely impacting mercury concentrations in populations of grebes living in their vicinity. Topaz Lake was one of those lakes. The Regional Board has included the conclusions from the USGS report by reference as a secondary line of evidence which supports the decision to list the waterbody for mercury impairment. The reference for this supporting data is ref4604 and can be found in the CalWQA database.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. 1 of 1 trophic level four composite tissue samples exceeded the objective for the COMM beneficial use; 5 of 5 small mouth bass samples exceeded the objective for the COMM beneficial use; 1 of 1 50-150mm length prey fish exceeded the applicable objective for the WILD beneficial use. These datasets exceed the allowable frequency listed in Table 4.1 of the Listing Policy.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.
 
Regional Board Staff Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

Evaluation Guideline: The USEPA 304(a) recommended water quality criterion for concentrations of methylmercury in fish tissue of trophic level 4 fish (150 - 500 mm; fillet wet weight) is 0.2 mg/kg. Total mercury is usually analyzed for most fish studies and assumed to be 100 percent methylmercury for the purposes of risk assessment (Klasing & Brodberg 2008). The fish consumption rate of 32 g/day is considered more protective of human health since recommendations are now to eat one meal per week of fish to obtain necessary Omega-3 nutrition. The fish consumption rate of 32 g/day is also protective of wildlife, as it protects 6 out of 7 endangered species.

Regional Board Staff Conclusion: This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status.

Four lines of evidence, two which assess E. coli data against the REC-1 beneficial use and two which assess fecal coliform data against the MUN beneficial use, are available in the administrative record to assess this pollutant. in August 2018 the State Water Resources Control Board adopted the bacteria provisions which use E. coli geometric means as the primary means of assessing the attainment of the REC-1 beneficial use. In the absence of E. coli geometric means, E. coli data computed to a Statistical Threshold Value (STV) can be used to assess the attainment of the beneficial use. The available E. coli data is as follows: 3 of 10 E. coli geometric mean samples exceed the water quality objective; 2 of 10 E. coli STV samples exceed the objective.

Lahontan Region 6 also has a fecal coliform water quality objective. Fecal coliform data were assessed against the MUN beneficial use and indicate a water quality impairment in Topaz Lake. The data are as follows: 15 of 24 fecal coliform samples exceed the geometric mean objective; 6 of 10 samples exceed the fecal coliform STV objective

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the CWA section 303(d) List as the available data indicates that there is an impairment caused by fecal coliform.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. 3 of 10 E. coli geometric mean samples exceed the water quality objective; 2 of 10 E. coli STV samples exceed the objective; 15 of 24 fecal coliform samples exceed the geometric mean objective; 6 of 10 samples exceed the fecal coliform STV objective. Fecal coliform data assessed against the MUN beneficial use exceeds the allowable frequency listed in Table 3.2 of the Listing Policy.
4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.
 
Regional Board Staff Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination for fecal coliform assessed against the MUN beneficial use should be placed on the section 303(d) list because applicable water quality standards are exceeded and a pollutant contributes to or causes the problem.

Data Used to Assess Water Quality: Water Board staff assessed SWAMP data for Topaz Lake to determine beneficial use support and results are as follows: 0 of 1 samples exceed the criterion for Endosulfan I. One composite (5 fish per composite) was generated from one species: Sacramento sucker. Details of the compositing protocol can be found in the March 2009 report entitled: "Contaminants in Fish from California Lakes and Reservoirs: Technical Report on Year One of a Two-Year Screening Study" (SWAMP, 2009).

There shall not be an increase in pesticide concentrations found in bottom sediments. There shall be no detectable increase in bioaccumulation of pesticides in aquatic life. Evaluation Guideline: National Academy of Science guidelines (NAS 1972) establish a maximum total Endosulfan concentration of 100 ug/Kg (wet weight) in tissue samples for protection of aquatic life from bioaccumulation of toxic substances.

Spatial Representation: Data for this line of evidence for Topaz Lake was collected at 1 monitoring site [ Topaz Lake - 631PTL196]. One sample was collected from 1 location. Individual sample locations consisted of an area within a given waterbody from which fish tissue samples were collected. The number of sample locations per waterbody was based on the overall size of the waterbody (SWAMP, 2010). Specifics of individual sampling locations can be found in the supplemental report entitled "Cruise Report for the Surface Waters Ambient Monitoring Program (SWAMP) Bioaccumulation Screening Study in California Lakes and Reservoirs, Sampling Dates: June 2007- March 2008" (SWAMP, 2008).
