Bryant Creek is the receiving water for Leviathan, Mountaineer and Poison Creeks, flowing north-east from Monitor Pass in eastern Alpine Co, CA. Leviathan Mine, a federal superfund site administered by USEPA and the Lahontan Water Board is located approximately 10 miles upstream. It follows that Bryant Creek is the receiving water for acid mine drainage flowing from the site, and can be expected to display environmental impacts from such pollution.

The California Stream Condition Index (CSCI) is a biological scoring tool that helps aquatic resource managers translate complex data about benthic macroinvertebrates found living in a stream into an overall measure of stream health. The CSCI score is calculated by comparing the expected condition with actual (observed) results (Rhen, A.C. et al., 2015). CSCI scores range from 0 (highly degraded) to greater than 1 (equivalent to reference). Implementation Action Other than TMDL:	An alternative enforceable program, which is the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), is in place that will address metals and other acid mine drainage associated with the exceedances of water quality standards for this water segment. In May 2000, the USEPA placed the Leviathan mine on the CERCLA National Priorities List (NPL), thus making Leviathan mine a Superfund site. The cleanup process at Leviathan mine is required to meet all environmental requirements, or ARARs (applicable or relevant and appropriate requirements) during its operation. The Leviathan mine is in the Remedial Investigation/Feasibility Study stage of the CERCLA process. A Record of Decision is expected in 2010.

An alternative enforceable program Comprehensive Environmental Response, Compensation, and Liability Act is in place that will address metals and other acid mine drainage associated with the exceedances of water quality standards for this water segment. Based on the readily available information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list.
